Here is an interesting case: A lives on top of a 20 foot retaining wall, B lives below it. However, A and B have a common boundary on the retaining wall which covers only 10%. But it was A that erected it. The other 90% was holding an empty land, but A wanted to make it safe for him and his neighbor B. Several years later, along came C. He bought that empty land to construct a house. During construction, the retaining wall moved (not collapsed yet). BTW, the retaining wall falls under the drainage reserves belonging to the Local Authority (LA). Who takes the blame? A - for not building the retaining wall with enough strength B - for not reporting any movement of the wall C - for not strengthing the wall before construction LA - the wall lies within its jurisdiction
