The presumption of innocence is in court. It means that the People have to prove the defendant guilty and the presumption is in the defendants favor during trial. The presumption of innocence does not mean we have to presume innocence on a personal level. If we see a robbery and the police arrive while it is going on, that person is also presumed innocent when the trial starts. People love to mix up a rebuttable presumption with reality.
