Hizb ut Tahrir Sun · Why ISIS is not Khilafah We do not reject the Khilafah, whether brought by al-Baghdadi or anyone else, because it is a Shariah rule. But we reject the contract of al- Khilafah concluded by al-Baghdadi for himself in his quality as a chieftain of an organisation, not an Amir for the believers. We reject turning the organisation into the Ummah, just like the communist party did, when it confined the elections to its cadres and not its nation. We reject the trivialising and the distorting of the concept of al- Khilafah, since it is not a mere piece of land over which al-Hudud (the penal codes) are implemented. Saudi Arabia implements al-Hudud, yet it is among the most notorious Kufr regimes on earth, and so does the sultanate of Brunei. We reject the exploiting of al- Khilafah to divide the Ummah on sectarian or geographic or demographic grounds, according to concoctions dictated by international politics and the interests of major powers. Al-Baghdadi took the Bayaah from the decision-makers within his group and not the decision-makers of the Ummah, and not even from the decision-makers of the majority of people living in the areas where he purportedly established his state. This does not render the authority to the Ummah and does not grant it the attribute of an Islamic state, because it is the state of a party and not the state of an Ummah, even if the party were Islamic. Authenticating the contract of al- Khilafah is effectuated by allowing people to express their opinion in respect of the man the decision-makers have chosen. If the masses expressed their aversion to him - which is exactly what happened - the Khilafah could not contracted because the decision-makers representation of the masses would not be genuine; thus it would be prohibited to take the Bayaah of obedience by force because the contract would be flawed in terms of the persons who the Khilafah is contracted through their Bayaah, and in terms of the entity of the state and its security. Hence, there is no obedience to the pretender of al- Khilafah as long as the contractual Bayaah is not sound. The bloodshed al-Baghdadi is perpetrating against the Muslims under the guise of the obligation to obey the Khalifah is illegitimate. The members of the Jihadi movements should fear Allah because what the enemies of the Ummah are plotting is rivers of Muslim blood, in order to coerce them into endorsing the final formula for Iraq and the region. This plot is conspicuously reflected in al-Malikis persistence on ruling, so that he may lead a sectarian and ethnic bloodbath.
