Subject : Contempt of Hon’ble Supreme Court of India, directions in the matter of judgment delivered in case of A.V. Papayya Sastry & Ors.Vs. Govt. Of A.P. & Ors. On 7 March,2007. & in the matter of Anguri Devi v/s Moti Ram & Ors.) 2003(1) civil Court case 85(P&H) which says that “No Judgment of a court,no order of a minister ,can be allowed to stand ,if it has been obtained by fraud”. Thus Violation of Hon’ble Supreme Court’s Directions and violation of Law by Ld.Magistrate Shri Mahendra Bade ,Dahanu Court and complaint to Hon’ble Chief Justice Shri Mohit Shah about said Contempt of Hon’ble Supreme Court , has wilfully neglected with ulterior motive to protect & save the acused/builder who have obtained the order by fraud on court on the basis of false,forged and fabricated revenue record of my landed property , and to harass the Complainant with wrongfull intention to grab her valuable landed properties at Dahanu which is the livelihood of Complainant, given by her late mother for her survival, which appears to me a very serious offence, a well organised Crime and violation of my human rights , by said Hon’ble C.J., H.C.,Bombay, and said Ld.Magistrate Shri Mahendra Bade which are punishable under law as per Section 166,166A,167, 217, 218,219 of IPC and Contempt of Court Act. Thus suo-motu legal action /deemed permission is required to take strict legal action on said C.J & Ld.Magistrate who has not acted in good faith. The strict legal action must be taken agianst them which is in the interest of justice and in the interest of maintaining the faith ,confidence & dignity of judiciary, & in the interest of Nation. Respected Your Honor, I, Ms.Roshani Sukhraj Bafna, age 53 yrs., most respectfully beg to take suo motu legal action by Your Honor/ deemed permission to prosecute to Chief Justice Shri Mohit Shah, H.C.Bombay , who has wilfully neglected my complaints to him to protect the accused. The Said Chief Justice Shri Mohit Shah & Ld.Magistrate Shri Mahendra Bade have neglected the order obtained by fraud on court by builder Vijay Shah at Dahanu in conspiracy with officers at Dahanu, with ulterior motive to grab my valuable landed property at Dahanu,and to make me a loss. They have violated the Supreme Courts Directions laid down in case of A.V. Papaya Sastry & Ors. Vs. Govt. Of A.P. & Ors. On 7 th March ,2007, which says that “no judgment of a court, no order of a minister,can be allowed to stand, if it has been obtained by fraud . By disobeying the directions of Hon’ble Supreme Court Of India they have committed Contempt of Court of Hon’ble Supreme Court. They also shown disrespect of Hon’ble Supreme court directions by denying me to hear the case on merit ,which is filed by me, with sole intention to protect the builder and to grab my valuable landed property. Thus they snached my livelihood and brought me on road .They snatched my livelihood and made me to run from pillar to post . The earlier Ld.Magistrate at Dahanu has poured my land in to the throght of builder Vijay Ghodawat@Shah by fraud on court on the basis of false,forged and fabricated 7/12 extracts of my landed property ,that is too within 4 months ,without making me a party .A suit filed by me being No.19/2014 to set aside said order obtained by fraud, is not heard on merit of the case, thus flouted the directions of Hon’ble Supreme court by said Ld.Magistrate Shri Mahendra Bade to protect the accused and complaint were overlooked by Hon’ble Chief Justice Shri Mohit Shah to protect the accused and to make me a loss. The said Ld.Magistrate has also refused for investingation to be made by police as regards false forged and fabricated revenu record of my landed property at village Sarawli,Dahanu,( application u/s s.156 of Cr.P.C. was rejected) which certainly shows his malafide intension to protect the accused and to grab my landed property. I say that the landed property at Dahanu was gifted & bequeathed to me for my survival by my late mother Smt.Udayprabha Bafna who was a successful farmer & businesswomen. My mother was very much anxious about my future as when she was alive my matrimonial matters were going on and I was subjected to cruelty for dowry at the hands of my greedy husband & in-laws,who have misappropriated my gold ornaments & valuables worth in lakhs of ruppes.(FCA 37/1992). After 17 years struggle and legal battle I received Rs. 16 lakh towards my return back of ornaments & valuable. Thus the amount kept by my mother and the said 16 lakhs were invested by me in various securities through broker Motilal Oswal and his sub-brokers, Ramniklal Shah,Natwarlal Shah at Dahanu as they induced me on their false representation. Unfortunately, without my fault I again caught in the hands of cheater and corrupt judicial officers who protected accused, played various illegal tactics to prolong the cases for years & years and poured my landed propety at Dahanu in the throght of builder by fraud on court. I am pained to say that said builder has not made me a party in suit filed by him and on the basis of false,forged and fabricated 7/12 extracts of my landed property he obtained the order in his favor and got declaration as owner of my property within 4 months when I was not in Dahanu. Complaint filed by me to police ,magistrate Court at Dahanu and Cr.W.P.no.2037/2014 before Hon’ble High Court,Mumbai was dispossed off on 10.6.2014 without hearing me. Complaint dt.19.6.2014 to Hon’ble C.J. & request to avail my right to be heard , proved futile, which compelled me to protest by fasting till I get hearing before Hon’ble Justice Shri V.M.Kanade,High Court, Bombay. While hearing Restoration Application, I brought the facts before said Hon’ble Justice Shri Kanade that builder and his adv. Marwadi have wilfully avoided to serve me the copy of affidavit dt.10.6.2014 filed by them in Cr.W.P.No.2037/2014 , I was threatened to take legal action against me best reason known to them. I am pained to say that though the said Cr.W.P. 2037/2014 is restored by said Hon’ble Justice Shri Kanade , till today I am made to suffer without any ad-interim relief prayed by me and giving dates after dates without any reason. Thus running from Dahanu Court ,Palghar Court & High Court,Bombay since last 28 years with 5 to 10 kg.court papers , I lost not only my all wealth but lost precious human life, health, lost all teeth,suffered from T.B., and many ailments and now mountaining loan amount from friends and relatives compelling me to end the life before corrupt court by Mundan & fasting as it appears to me the death of Justice & democracy. Thus my human rights are violated by Shri Mohit Shsh, C.J.Bombay High Court, who inspite of bringing all theses facts through 19 complaints has not taken any legal action on corrupt officers and protected to accused with ulterior motive to grab my all wealth ,thus caused me wrongfull loss of wealth & health which can’t be compensated in any terms. I am pained to say that after receiving the letter dt. 5.9.2014 from the higher authority,( No. L-15012/4/2014 Jus,Dt.5.9.2014) Delhi , some corrupt judicial officers have started harassing me at the cost of contempt of court . Corrupt Officers are also manipulating the record of dates in my 3 matters ie. Cr.W.P.2037/2014, Cr.Appeal No. 1146/2013,Cr.Revision No.268/2014 so that long list of dates should not come to the notice of Higher authorities. The copy of list of dates annexed herein will certainly reveal the said bitter truth stated by me. Thus in view of above facts, it appears to me a well organised Crime & offence,violation of directions of Hon’ble SC, and violation of my human rights , by said Hon’ble Chief Justice Shri Mohit Shah, High Court,Bombay ,who is already found not fit to appoint as a Supreme Court Judge by the report given by Hon’ble CJI to Hon’ble President of India,which are punishable under law as per Section 166,166A,167, 217, 218,219 of IPC and Contempt of Court Act. Thus suo-motu legal action /deemed permission is required to take strict legal action on said C.J which is in the interest of justice and in the interest of maintaining the faith ,confidence & dignity of judiciary. I am pained to say that earlier also I became the victim of grave injustice at the hands of then Chief Justice Shri Bhattacharji of Bombay High Court who had denied my right to be heard and brought me on road bypassing the directions of final order & judgment of my matrimonial matters being FCA.No.37/1992 who has awarded to me shelter of one room residence at Shivaji Park,Mumbai in my matrimonial house with direction to my in-laws & husband not to interfear in my stay while confirming the issue of cruelty on wife. It will not be out of place to mention here that said CJ.was caught in violation of FERA act and for accepting Rs.70 lakh from most wanted terrorist Iqbal Mirchi.He was them made to resign. At that time said news alongwith injustice suffered by me was published in several leading newspaper which is herein enclosed. I humbly say that if I would be deleivered justice in time, I would have continued my work of giving ROSHANI (Eyesight) to many poor villagers as I have successfully arranged and financed Free Residential Eye Campes before I have been cheated by accused, and thousands of needy people were benifited & operated for cateract. The said news was published in local newspaper as “Abhutpurv Safalta”.The copies are herein enclosed. I herein most respectfully request to deliver speedy justice to me in above 3 matters, and restore my landed property as an interim relief to enable me to lead my rest of life peacefully as well as to enable me continue to give helping hand to poor aadiwasi who are the residence around my land and most of the children are suffering from malnutrition at village Sarawli@Manfod ,Dahanu, which is in the interest of justice and in the interest of Nation.
