Hoovler Announces Prison for Woman Who Abandoned Newborn in Shopping Bag Mother sentenced to 2½ to 5 years in prison for abandoning baby in Middletown drug location Goshen, NY – Orange County District Attorney David M. Hoovler today announced that Tammi Green, 38, of Middletown, was sentenced to 2 ½ to 5 years in state prison in connection with her having abandoned her newborn baby in a known drug location in the City of Middletown. On February 28, 2013, Green, who had been pregnant for approximately 30 weeks, was inside an apartment at 120 Wickham Avenue. Green had been warned by a foster care case worker that she should not go to that location and ingest cocaine. Prosecutors had argued in court that Green went to the location, purchased and ingested cocaine there, and then gave birth to a baby girl. Green abandoned the newborn by placing her in a shopping bag which she secreted in the apartment. Prosecutors argued that when City of Middletown Police Officers arrived Green denied having given birth that day, and then lied to the police saying she had placed the infant in the care of a relative. As a result of Green’s actions, it took the police a substantial amount of time to find and rescue the infant, who almost died as a result of the defendant’s actions. On October 24, 2013, Green pled guilty to Reckless Endangerment in the First Degree. At the District Attorney’s request, a Final Order of Protection was issued by County Court Judge Nicholas De Rosa, which forbids Green from having any further contact with the child. “This defendant placed her own baby in grave risk of death just to satisfy her narcotics habit,” District Attorney Hoovler said. “There can be no excuse for this defendant’s actions in hiding her baby from the very public servants who were trying to rescue the infant. I am gratified that the court agreed with our recommendation that this defendant be sentenced to state prison. This case demonstrates the insidious way narcotics are destroying our families. Hopefully this sentence will deter others who might be tempted to victimize children in their care.” District Attorney Hoovler thanked the City of Middletown Police Department for their assistance in the investigation and prosecution of this case.
