I am reviewing the transcript from a preliminary examination from back in December 2013. My client was accused of a crime and the DA had to present enough evidence to the court to show that 1) a crime may have occurred and 2) my client may have been involved in that crime. The results of the prelim determine whether the allegations are dismissed or if the criminal proceeding continue (ie. whether there is enough evidence to bind over the defendant on the complaint). Here is part of the conclusion of that prelim: DA: As the court has already heard the testimony in this case, that supports counts 1 and 2, the People do believe there is enough to bind over. Court: You are serious? DA: Yes, your honor. Court: You are speaking in the name [of the People] with a serious face? It did not get any better for the DA from there.
