I dont know whats more irritating: people that try to take advantage of young people or people that take it for granted that youre uneducated and try to get over... My son did some work for this company this summer in June and July. He has yet to be paid. They owe him almost $2,000. Heres my conversation this morning with their Payroll Department: ME: Hello, my name is LaShawne Holland and I am calling you because my 18 year old son worked for you in June and July and it is the middle of August and he has not been paid. This is a courtesy call to let you know that TODAY, I am prepared to file a civil lawsuit against your company for non-payment of wages. According to the Maryland Wage Payment and Collection Law, you were to pay him within a reasonable period of time. Because you neglected to do so, a lawsuit will entitle him to double the amount owed to him plus my attorney cost and other fees. Thats my first call. My second call will be to the Maryland State Employment Agency Division of Labor Standards Enforcement office to report you. My third call will be to my good friend, who happens to be the State Attorney General of Maryland and our kids have been going to school together for years. Then I will go on Social Media and tag you in this story of how your company has tried to take advantage of an 18 year old college student, while also tagging the IRS because you failed to provide him with the proper federal forms, but I had to download them and submit them to you. He was an actual employee of your company and not a contractor because you supplied the materials for him to perform his duties, and I think this is called Work for Hire under the Employment Law and he filled out the application, the MD 507, the W-4 form and the I-9, all of which I have copies of and a fax confirmation of the documents being sent to you, with the date and time. And, before I let you go, I can get this filed fairly quickly because one of my best friends is a Chief Judge and my sons aunt is an attorney. THE RESPONSE: Mrs. Holland, I think we can get this rectified quickly. ME: Thank you. You have until 12:00 noon to call me back with a time that I can come pick up his check. Any longer and I will be at the Court House in Upper Marlboro filing this suit by 12:30 pm. Have a blessed day.
