I know that Ive probably alienated some people because of my cautious approach to Premier Newmans anti-bikie laws. Im certainly not welded to my position, and am waiting to see any firm evidence of the misapplication of these laws. In the meantime, my position on these laws rests on two propositions: 1. These extreme laws (and they are extreme) did not come to be in a vacuum. There are, I believe, some people who are genuine motorbike enthusiasts who like to get together socially and ride their bikes. There is, I firmly believe, another end to this spectrum, and that is highly organised trans-national crime gangs, who operate in a way indistinguishable from fascist militia. These people, who at the same time inhabit our society, with its legal protections, and and live outside it, imposing their own penalties and remedies which fall far outside our understanding of the rights of a citizen of this country, are imposing stresses on our society, and the Queensland laws are one symptom, or aspect, of this stress. 2. If one looks at the list of organisations which have been banned in Queensland, it will be seen that they are not, in most, or perhaps all instances, indigenous Australian organisations, but they are subsets of foreign organisations, and therefore an argument can be made that they are a foreign affairs matter, and therefore fall clearly within the ambit of the Commonwealth Government, under the external affairs powers of the constitution, possibly (indeed probably) under existing anti-terrorism legislation. These problems will not be solved by the overthrow of Newmans laws, whether or not this is merited. The battle (for such it is) will merely move to the next phase. One of the outcomes is, for instance, for a totally innocent victim, quite possibly a child, to be horribly burnt to death in an incendiary bomb attack gone wrong, or die in a shooting (this has almost happened so many times, it is a certainty that it will occur, probably in the not too distant future). Australian society may well then be convulsed in a unique way, with outcomes which will be traumatic. I believe it is time this whole argument and dilemma was clearly worked out in terms of the social contract (or contracts) which underlie the functioning of our society. The sooner the better.............
