I wanttocontinue writing about Health Care and how to make it AFFORTABLE. In my previous writing, I had enumerated some of the unintended consequences wich will occurr while trying to reduce Health Care costs. However, there is another major area where Health Carecosts can bereducedsignificantly about which I like to write today! The hallmark of our _American_ jurisprudence has been JURY TRIAL, which, in general we all consider outstanding, Except in cases of Medical Malpractice. No matter how educated the jury members( unfortunately often, many are not,) the intricacies of medical malpractice cases are not understood by jury members, hence their judgment is frequently based on EMOTIONS rather then on EVIDENCE! It is often argued that EXPERT WITNesses clarify and explain the case to the jury. Far from the truth, as expert witnesses are HIRED GUNS to defend their payers cause, contradict each other and utterly confuse jury members!!! The confused jury, based on emotion and aware of the persons injuries, awardsajudgement of SEVERAL MILLIONS for the plaintiff. Therefore, doctors have to pay huge premiums to insurance companies to cover themselves against those enormous and extravagant judgments, made by the jury! It is said, that some doctors pay over $100,000.00 per year to cover themselves, thus increasing exponentially Health Care costs. The question, then is, who should try Medical Malpractice cases? In my opinion,by a committee of doctors, lawyers,judges,psychiaitrsts, member of clergy, social workers and accountants.Tthe judgment reached must be flexible and adjusted every year according to the injured partys condition.
