If you work as an artist and you earn very little income from that work, can you still claim to be a professional artist? In a ruling handed down late last week by the United States Tax Court and seen by many as an important victory for artists, the answer is yes. The case concerned artist Susan Crile, who the I.R.S. said could not deduct the expenses of her art. PLACE serves many such artists by providing them with affordable space to live and work, access to shared facilities like theater space and gallery space, and a collaborative community. Yet, many people want to define them by how much money they earn. The court ruled that in carrying on her activity as an artist, Ms. Crile had an actual and honest objective of making a profit” and therefore under tax law should be considered a professional artist.
