It is a fundamental deprivation of fundamental rights, to wilfully obstruct any due grand jury inquiry into any alleged deprivation of fundamental of rights. Likewise, any obstruction of any due grand jury inquiry is an offense equal in seriousness to the original offense due for such inquiry. Under the most fundamental and well known principles of American law, supported by all other real and permanent laws recognized by the people of the United States, we have held certain truths to be self-evident. It is now, and always will be a fundamental maxim of American law, that all men are created equal, endowed by their Creator with certain unalienable Rights, and among them are Life, Liberty and the pursuit of Happiness. --that to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed. The people irrevocably have original, independent, and practically enforceable jurisdiction over the security of these rights, and over any and all claimed or assumed right to have or hold any government position whatsoever. The peoples safe repository and independent political arm designed to enforce such security is none other than the grand jury. The governed do not consent to public offenses under the color of law. The governed do not consent to grand juries subject to the very officials they are meant to investigate, or for that matter, any grand jury subject to conflicting interests, or to any process that is not fundamentally fair. Obstructed public access for the submission of evidence to grand juries has always been fundamentally unfair and has always been fundamentally unlawful.
