It seems everyone likes to think that the word Individual means A PERSON when applied to 42 USC 18115. In the context of the way the statute is written, since individual is not capitalized it is not a noun. Therefore it is an adjective describing one from a group. Next we have the first comma after individual, you use a comma to separate the elements in a series (three or more things). If we lay out the actual statute in a bullet point fashion then it would read, No individual, a) company b) business c) non profit entity d) or health insurance issuer offering group or individual health insurance coverage shall be required to participate in any Federal health insurance program created under this Act (or any amendments made by this Act), or in any Federal health insurance program expanded by this Act (or any such amendments), and there shall be no penalty or fine imposed upon any such issuer for choosing not to participate in such programs. This is the problem we have today, people read the words but do not understand the meanings and grammar usage in legaleese.
