JUVENILE TANTRUM OVER DAP: I wonder what the intention was of the Office of the President in saying that it will abide by whatever decision the Supreme Court will issue on the petitions contesting the constitutionality of President Aquino’s disbursement acceleration program (DAP), or his spending the money representing supposed savings from the budgets given to executive departments, for the other branches of government. Of course, Malacanang should abide by the decision of the Supreme Court, even if President Aquino would not be happy with the decision of the tribunal. The Supreme Court is the constitutionally-mandated agency of government in the interpretation of laws, and in deciding judicial controversies, and everyone but everyone should obey it at all times. As it is, statements, like the Palace by the Pasig will follow the Supreme Court’s decision, serve rather as an open threat because it conveys the impression that the executive department could actually chose not to obey, and therefore give rise to a constitutional crisis. This is of course uncalled for, and were it not to be treated as a mere juvenile tantrum, is actually subversive of the rule of law, illegally asserting the superiority of the President over the judiciary. -ooo-
