The suit filed through a writ on April 26, 2010, has The Guardian, Ukwuoma, and the Pharmaceutical Society of Nigeria (PSN) as respondents. But at the continuation on Tuesday, counsel to The Guardian (first respondent) and Ukwuoma (second respondent), David Olusoga Fayemi, appearing with Amaka Anierobi, had informed the court of the death of Ukwuoma and asked that his name be struck out from the writ. The counsel also prayed the court for the substitution of the deceased sole witness in the matter, Late Mr. Ben Ukwuoma with Mr. Chukwuma Muanya, a senior health reporter in The Guardian. They also requested for the leave of the court to file an additional statement on oath. Justice Aneke granted the applications after parties in the matter did not raise any objection to the applications. According to the writ, the libel suit initiated against the respondents was predicated on a news report carried by The Guardian and written by the late Ukwuoma on the delisting of Tijani Mora, (the first plaintiff) from the Pharmaceutical Society of Nigeria (PSN) as contained in a press statement issued by the society.
