Judicial activism by a liberal Federal judge way off the reservation. In no way is a federal judge authorized to order a local official to enact a civil procedure or ordinances. This must come from an elected body...or by referendum. A judge does not have this kind of power. All they can do is interpret law, halt actions in violation of the law or under legal proceedings and issue sanctions on matters directly related to the court or on procedural grounds and sentence according to guideline. Further the appointment of a monitor is in direct conflict with the 10th amendment because the State is a separate sovereign and can therefore make and enforce its own laws in a manner consistent with state laws. Its up to the Supreme Court to decide if laws are legal. Jefferson would have defunded this circuit court in a heartbeat like he did while President. Congress needs to do the same This is an elected official being intimidated by a court out of control.
