ACM RECORDS BATTLES ‘TRADEMARK BULLYING’ Company calling for bands, venues and sponsors for planned National Concert Weekend supporting independent musicians (Fair Lawn, NJ) Feb. 10, 2014 - Back in 2008, the owners of ACM Records, Inc., wisely filed and obtained a USPTO (United States Patent and Trademark Office) registration for the “ACM Records” trademark. Three years later, on February 21, 2011, the USPTO rejected an application by the Academy of Country Music for use of the title “ACM Fan Jam,” finding that the name could easily be confused with the ACM Records trademark. Nonetheless, the Academy of Country Music continued to use “ACM” on CD’s released for their awards show and in ways that appeared to fall within the scope of the USPTO’s rejection. In the spirit of fairness, ACM Records owners Al Cohen and Eve Adams, whose company originated in 1981, never objected to the use of “ACM” as an acronym for an Academy of Country Music Awards show. They were stunned last spring when the Academy of Country Music filed suit against them (Academy of Country Music v. ACM Records, Inc., et al., CV13-02448 DDP [C.D. Cal. 2013]) to use and expand the ACM name in a case of what Cohen and Adams have coined ‘trademark bullying’. “We’ve had to persistently police our trademark,” Co-owner Eve Adams said. “We’ve been able to knock down a few individuals that were using our name, but the pending case has been interfering in our efforts. We feel people have taken advantage of the situation, and it has created more confusion on the Web.” The taxing experience has inspired Adams’ husband and partner to fight back through music. Through a song called “Stand Up for Your Rights,” Cohen declares, “Stand up for your rights / tell them when they’re wrong / Back what you believe and know when to be strong.” In a second composition called “That Ain’t Country,” Cohen speaks out even more directly with pointed lyrics including “Worked real hard to make ACM well-known / The American way independently owned / No matter what you do or say / You can’t take away my name / you can’t take away my fame / ‘cause That Ain’t Country at all.” The song performed by Al Pine will be released in March on ACM Records. Through whatever means are necessary, ACM Records will continue to protect their name and battle trademark bullying, Adams said. “We’re not powerless. We’ve earned our stripes and we are a successful independent music company,” she said. “We have to fight back—this is our baby; we’ve put our blood[AC1] , sweat, and tears into this company. They think that that because they have deep pockets, they can shove us to the wayside. Why should they take this away from us?” As part of the ongoing struggle to protect the ACM name and to draw attention to the plight of certain musicians and small companies everywhere in the industry, ACM Records is seeking bands, venues and sponsors for a National Concert Weekend to take place this summer in support of independent musicians.
