LAJSRI is happy to announce their 9th win from Saket District Courts, wherein learned ADJ was pleased to dismiss the Regular Civil Appeal filed by our opponent challenging the decree passed by the learned Civil Judge in favour of our client. We contended that (i) the appellant abjectly failed to show any errors apparent on face of the record or on facts or on law (ii) that the Plaintiff-appellant was filed earlier suit against the owner-predecessor of the suit property and he lost the battle there, as such cannot question the transfer of the property affected between our client and owner-Predecessor of the suit property and (iii) the appeal is vexatious absolutely no merit and liable to be dismissed with costs. Per contra, the appellant argued that (i) in first round litigation the trial court did not hold that the suit property indeed belongs to owner-predecessor of the suit property as such the title of the owner-predecessor is defective, therefore, the transfer affected between our client and the earlier owner is nullity. Learned ADJ agreed with our views and dismissed the appeal.
