LAW BECOMES WEAK WHEN ITS RULE DEPENDS ON TRUST July 31, 2014 at 4:19am The trusteeship in law administration is Nature oriented concept. The Nature evolved material world full of life on earth and also evolved Nature’s law governing such world, but delegated some power/authority for administration of some part of Nature’s law to human beings in trust and with belief that human intelligence as blessed by Nature will work well in keeping rule of law intact within such world. The same Nature oriented concept of trusteeship in law is carried forward by human beings/people by establishing State as the people’s agency for administration of such law in trust for people. In this way, the people first became the trusted agents of Nature in law and then State became the trusted agent of people in law, since the people were and are in scattered position. The power in law as delegated by Nature to human beings thus moves through trusteeship. The spirit of law in human mind is thus the spirit of trust. The Nature expects human beings to administer limited part of Nature’s law on the strength of Nature’s limited delegated power/authority in an intelligent way in trust for Nature so that all remain happy and peaceful by satisfaction of everybody’s selfishness within the limit fixed by law. The humans shall follow such limit of law against individual human selfishness is the trust put in by Nature in humans. But it is beyond understanding as to why the Nature is not withdrawing her power in law delegated to humans when there has been a continuous breach of trust by humans in relation to such delegated authority. The same is the case with people’s agency of law called State. The people have been forced by circumstance of their scattered position to helplessly watch the breach of their trust in law by law enforcement authorities within State. It is an open secret that few over selfish people on the strength of their money power succeed in managing some corrupt law administrators to serve their vested interests. This bribe culture generated within system of law by few corrupt law enforcement officers makes it very difficult for honest law enforcement officers to enforce law in its true spirit and in true trust for people. The judiciary has its own limit in checking and controlling of such corruption and breach of trust. This is because the judges are also human beings with all human weaknesses. The people in general lose their faith in concept of rule of law when they openly see that law can be easily manipulated or managed by bribe culture getting established within system of law and to some extent also within human society. The bribe culture means low spirit of law shamelessly committing breach of trust in law. The slogan of law “Be you ever so high, the law is above you” becomes only a showpiece within such corrupt/bribe culture. The Nature/God must be laughing at her/his own mistake of delegating some power in law to humans, by putting her/his trust in such humans as trusted law administrators. –Adv.B.S.More
