Legal Tip of the Day-Notice to Insurance Commissioner and Insurance Consumer Advocate (Georgia Automobile Insurance Law-Frank E. Jenkins III and Wallace Miller III) O.C.G.A. section 33-4-6(b) requires an insured to give written notice of filing a lawsuit to the insurance commissioner and to the state insurance consumer advocate. The demand for payment and the complaint should be mailed first class within 20 days of filing suit against an insurer for bad faith. If, according to the statute, notice is not mailed within 20 days of filing suit, failure to give notice may be cured by subsequent delivery. But even with that, the statute imposes no penalty for complete failure to give notice.
