MARIJUANA IS LEGAL IN ALL THE STATES AND FEDERALLY -- start of Rant -- Marijuana is already regulated by the Minnesota Board of Pharmacy under what is commonly called the Controlled Substances Act. It is possible to obtain, and companies in Minnesota have obtained, licenses to do things with the Controlled parts of the Cannabis Plant. Understand that the sterilized seed and also the fiber and products made from the fiber of the Marijuana (Cannabis) plant are entirely legal and you will find bird seed in every pet store that contains Hemp seed. The problem is that the Minnesota Board of Pharmacy is not compelled to issue permits for people to Grow, Distribute and even sell Cannabis which is controlled, or the medical part of the plant. It is totally up to one person at the MN Board of Pharmacy that denies permits they deem not in the best interest of the state. This of course causes problems with obtaining a permit from the Federal Authorities. The Federal Agency in charge of issuing permits for Marijuana, the Drug Enforcement Agency, will not issue or consider a permit unless the state agency in charge has already approved the permit pending DEA approval. Clearly a Catch 22 is in place when it comes to Marijuana. There is a process by which people could legally register and pay fees to the state to produce and distribute marijuana for medical or other purposes but the agency that oversees this process refuses to issue the licenses. I liken this to what if MN DOT decided that driving cars was too dangerous and the agency refused to issue drivers licenses to anyone. Of course there would be an outrage at such a step, yet the MN Board of Pharmacy will only issue licenses to people who they deem to be doing what they wish them to do. If the MN Board of Pharmacy says no one has ever applied for such a permit, they are not telling you the truth. Myself personally have attempted to obtain a permit from the MN Board of Pharmacy, the MN Department of Agriculture and also the DEA. I know of others who would like to comply with the laws and obtain the licensing necessary but are extremely frustrated by the State Agencies that stand in our way. Myself I wished to grow a strain of Cannabis that would be used to make textile products and contains little of the THC that everyone is so worried about. Until a full investigation is done on the Minnesota Board of Pharmacy and they are required to issue permits which under current law they are able to issue any attempt to legalize any form of a Cannabis Medication in the end it will fail to achieve the objective. The State of Minnesota already has a law that allows for the University of Minnesota to investigate medical properties of Cannabis but dont because they cant get the permits from the Minnesota Board of Pharmacy. I wish you well, however even Governor Ventura a very much Pro Marijuana Legalization advocate vetoed a Medical Marijuana bill. That bill would have only allowed patients to enter Mitigating circumstances into a court case when a patient is caught with Marijuana. Something I think you would say should be allowed but to date isnt and actually has a supreme court ruling against the introduction of such evidence into any stage of a marijuana trial. -- end of rant --
