MARITAL PROBLEM IN COURT 24 June 1947 BRISBANE, June 23.— The question of whether a woman of advanced years was entitled to refute her husband marital rights arose in a divorce suit heard by Mr. Justice Douglas to-day. Johann Albert Dorr. painter, who said he had not cohabited with his wife for 15 years, complained that since she had deserted him. He said he married (the respondent, Olcna Dorr, at Pialba. in 1936 and lived with her in Maryborough. There were three children of the marriage. During the depression years, he said, he came to Brisbane to work and sent his wife money. Hls wife first refused him marital relations in 1931. In 1943 he visited her and she refused him marital relations. He stayed with her for a few days, but she refused to get meals for him. She told him that a man past 40 should not want anything to do with a woman. His Honour asked Mr. D. Casey, for plaintiff, at what age he considered a woman would be justified in refusing her husband marital rights. Mr. Casey said he did not know. Decision was reserved.
