MEMORANDUM FROM THE OFFICE OF THE ADMINISTRATOR TO: The WSU Community FROM: Prof LR van Staden DATE: 22 August 2013 COMMUNICATION CORRECTIONS: It has come to my attention that there are some misleading rumours which are creating confusion for our staff and need to be corrected. Please take note of the following: Management has withdrawn the labour court application to declare the strike illegal. There is no pending court case. In any event that court application had nothing to do with the ‘no work, no pay’ rule. It is the labour relations act which determines that strikers are not paid. It is up to staff to determine when the strike will end by supporting the management offer that is on the table. There are rumours that our labour unions are taking WSU management to court next Tuesday to declare the ‘no work no pay’ rule illegal. This is not true. No court papers have been served and there are no pending court matters. The ‘no work, no pay’ rule has been legally implemented in terms of the labour law. It is normal for this rule to be applied. If unions decide to strike and withdraw labour, management is fully entitled to withhold pay. There is also a rumour that staff will be paid this Friday. This is not true. The ‘no work, no pay’ rule came into effect on 29 July, 2013 and was implemented on 15 August, 2013. It will remain in place until the strike ends and the lockout is lifted. Staff who sign the undertaking presently on the table will have the ‘no work, no pay’’ rule lifted upon signing. There are many queries from staff who are not members of either union and who do not support the strike. Even though staff are not members of a union, they also derive benefit from negotiations made by unions. The current strike action and the lockout legally affects all staff including staff who do not participate in the strike. The request on the undertaking form for staff to dissociate themselves from the strike is not confirmation that a particular staff member is on strike. Its purpose is to ensure that staff do not go back to striking on the present deadlock. Finally, all staff have a constitutional right to make their own decision on whether or not to sign the Management Offer. Reports of intimidation have been received and we strongly condemn these. Intimidation and threats against staff who wish to accept the offer are illegal and must be reported. Thank you. Professor L R van Staden Administrator
