Mohammad Dilawar Mir resigns from PDP General Secretary post Party accepts resignation Mir set high moral standards of public probity: Mehbooba Srinagar, Nov12: Mr Mohammad Dilawar Mir, General Secretary of the Peoples Democratic Party (PDP) has tendered his resignation from his post. This comes in wake of a recent verdict against him by a Delhi court. Accepting the offer of Mir to step down from the party post, the party president, Ms Mehbooba Mufti said it was a hard decision for her but given the fact that Mir had taken a moral call on the issue; he has set high moral standards of public probity. Mehbooba expressed the hope that Mir who has sought a legal remedy against the verdict would soon come out clean on the issue. Here is the text of the resignation letter sent by Mr Mohammad Dilawar Mir which was received by the party president, Ms Mehbooba Mufti today. ---------------------------------------------------------------------------------------------- I am releasing this note to the press to State the facts and clarify my position with respect to a report published in some local newspapers, based on newsletter circulated by PTI: The published reports make the following points: a) That I have been sentenced to undergo three years rigorous imprisonment and pay a fine of Rs. 3.21 crores. This order against me is primarily based on two points: First that the contract was awarded to me by the General Manager of NFL and Secondly payment of Rs. 30 lacs was released to me by him as advance payment. That both these acts were done by the General Manager without authority. These findings are wrong. The General Manager, according to best information available, had been delegate the requisite authority by the Finance Department. Secondly, Rs. 30 las were not paid to my firm as advance for no services rendered but as on account payment due to my firm, for the services already rendered. b) The second assertion made in the published reports is that the sentence passed by the Trial Court has been stayed by the Court itself till January, 2nd 2015. c) The third assertion made in the published reports, based on PTI news letter is that in view of the conviction, I cannot contest the forthcoming elections. This comment is legally untenable because the sentence against me has been stayed till January 2nd2015 and there is no legal impediment if I decide to contest the forthcoming elections. It is important to note two fundamental facts. First, that when the contract was awarded to me, I was neither a Minister nor a MLA. I was a private citizen and had a fundamental right to do business. Therefore, there is no allegation or finding that i have committed any wrong doing as a public servant. The second aspect, which should clinch the issue, is that the court has noted and accepted the fact that as a public servant, I have had impeccable and clean record. Even though the facts and law are in my favour, I have decided to set a high moral standard in my public life and submitted my resignation as General Secretary of PDP to the President of the Party. I am confident that in due process of law, truth and justice will prevail and my position will be vindicated.
