My ex husband and I have a 13 year old daughter. The last almost 5 years we have been going to court. I have 60% custody he has 40% I have has several attorneys and have paid so much money to have her back in my life. In May of 2009 I went to my ex and told him i was 5 months clean I had gotten addicted to opioids for 2 years and went to a 10 day detox and told him because I am in a program of being honest. It was the worst mistake of my life. A month later DCF came out and checked my home and drug tested me and spoke to our daughter and after a week I was released and able to pick her up at my next visitation schedule. The next day his attorney called me, I did not have one, and stated they would not be home and I had to have a supervised visit at a park with my ex and his wife. I called the DCF supervisor that was dealing with our case and said if there is no court order go to the park and pick her up. So I did that. I put our daughter in my car and everything went nuts. My ex a wife started attacking me and she grabbed a hold of one of my childs arms and I grabbed the other as soon as she tugged on her I let go because I was not going to play tug of war. The police were called and that day I was arrested for battery on my exes wife and child abuse because our daughter had a scratch on her arm. To this day I dont know if I was the one that scratched her. I spent the night in jail on Mothers Day weekend! It was a horrible feeling and I was so upset because I didnt attack anyone. When I got out and went to family court a week later the judge gave me 1.5 hours a week at kids in distress. I walked out of that hearing in a fog. She came to 3 visits and then my ex said she refused to come. For years I have gone back in forth in court. 5 court ordered mediations, 3 different attorneys. The criminal case was so bad I had to retain a attorney. I went to court one day and found out that my charges were upgraded to interference with child custody and got re arrested in the middle of the courtroom. To find out when I was released he told the police and the state attorney he had a restraining order against me that day. I went through the system and found out he never had a restraining order he lied to the police. So you think after proving that they would drop that. No it took a year of fighting to prove it even though it can be easily verified in the system. When they did drop it I asked why they were not going to charge him with anything and they said they dont make a habit out of prosecuting cops. Yes my ex is a cop of 26 years and fully knows how to get a RA and lied. I have had court order reunification with out daughter and after 8 months the therapist set up a schedule for a few hours each Saturday for her and I to go out alone and my ex refused. We have had 3 family court judges in this case and my new attorney put in for reunification again and a gaudien at lidem. The judge said there is something wrong with this case and he requested to speak with our 13 year old daughter before he grants anymore motions. The reason why I am writing is because I was wondering if anyone had any experience with how much the judge would listen to she just wants to live with her dad. There is serious alienation and brainwashing my daughter says she hates me. But I refused to give up. The very little time I have spent with her these last 5 years was positive but it gets ruined because my ex wont bring her or listen to court orders. Which he has been in contempt many times but does not seem to phase him that he has to pay money to my lawyer. Out judge now was in dependency court prior to being a family judge and I pray he sees what is really going on. Do judges really only take into consideration what a 13 year old say?
