Though the Officers’ cadre of the CAPFs have fully matured, being in existence for more than 48 years in the case of the BSF and many more in the case of CRPF, they have not yet been accorded the status of an “Organised Service” by the Government. This has resulted in not only denial of status but also various privileges that are intrinsic to Organised Services of the Government of India. It is paradoxical that the Government of India has chosen not to constitute the CAPF officers cadre, which is providing leadership to more than 7 lac strong CAPF personnel who are engaged in crucial National Security Functions, as an organised service. 2. Due to unjustified and inexplicable reasons the Government is deliberately denying them rightful dues to the extent that the Non-Functional Up-gradation (NFU) up to the level of Joint Secretary, which was allowed in favour of all Central Civil Services, has not been granted to them. Consequently, many BSF officers stagnate for long years in lower posts while their counterparts in other civil services as well as in the medical services within the Central Armed Police Forces, of which the BSF is one, get elevated to higher pay scales. A peculiar and paradoxical situation is emerging in the CAPFs wherein a DIG in charge of a sector would be drawing lesser pay, travel in a lower class and live in a lower category of residence vis-à-vis the medical officers placed under his command, thus paving way for breeding indiscipline in these Armed Forces of the Union. 3. The BSF, like the CRPF, ITBP, SSB and CISF, are Armed Forces of the Union like the Army, Navy and the Air Force, all of which fall within Union List -1, Entry-2 of 7th Schedule of the Constitution of India. Nevertheless, they have been excluded from the post retirement benefit of One Rank One Pension (OROP) which has been sanctioned in favour of the Army, Navy and Air Force. 4. CAPF personnel have not been extended the facility of casting their votes at their respective places of posting, which would permanently dis-enfranchise about 75% of the Force personnel. It appears that their case has been completely forgotten when similar case in respect of Defence Services personnel was granted. 5. CAPF personnel who retire after rendering unimaginably tough and hazardous service in preserving the integrity of the State have not been extended the benefits of Ex-Servicemen by the State Governments, except for the states of Uttarakhand and Goa. The states have not taken due cognizance of an order issued by the MHA declaring the retired CAPF personnel as EX-CAPF personnel for the purpose of extending benefits. They are by and large ignorant of these facts and otherwise remain bogged down with day to day work. There is no reason for them to spare their hear for such issues. There working is based on core principle of disposal of receipts with almost no consideration of the end users. Our proposals giving correct reference to respective constitutional provisions, which should also contain demand for arrears can make them consider as they wont have scope for raising the standard observation how and why it is being regulated till now ? Only an informed officer could make this beginning, which explains why it was not raised earlier. As regards projection of all such issues by the DG, no Govt would ever appreciate unless there is seemingly wide spread .................. I might be wrong to some extent ,but improve your digestive system, its truth. A few days back, I read a DO letter written by the Railway Minister to Finance Minister to abolish new pension scheme(NPS) for Railway employees who have joined on or after 01/01/2004. Railway Ministry has projected the hardship faced by its personnel on the similar lines as that of Defense personnel who have been exempted from NPS due to tough serving conditions. If Railway Minister can recommend for its employees, why not MHA can recommend for the same to CAPFs, as we are serving in much more tougher conditions than Railways. A few months back, during our NFU case hearing at Hon Delhi High Court, I learnt that the ASG/MHA has stated that govt has granted adequate welfare and allowances to CAPFs. If it is so then why CAPFs are going to court ? I was astonished at the statement of ASG, as it reflects the general attitude of Ministry while dealing with the grievances of CAPFs. Defense Ministry has a history to back the general welfare and legitimate demands of its personnel. It seems that MHA is the only Ministry which goes against its employees to redress their grievances. As a result, CAPFs are knocking the doors of hon. courts to settle their dues. I hope a day will come when CAPFs will get justice. Jai Hind. Reply Dharani1 May 2014 12:14 Sir, well written thoughts and our plight rightly exposed. I beg to mention certain pertinent points which may anger many.The so-called CAPFs especially BSF, find themselves in this predicament because they are at the mercy of IPS leadership who almost tow the bureaucratic line due to obvious reasons. Why is the Assam Rifles or the Coast Guards better off or better looked after than the BSF? Senior level command including the post of DG should be given to Army Generals to transform the BSF as truly Para Military considering its role and task in war and peace. Why blame the Govt when there is vested interests in the Force itself discriminating against promotees? Why is this talk about stagnation among direct entry officers only when a constable gets only five promotions at the most and a direct entry Sub Inspector gets as many( about five) promotions only ?( The unwritten rule followed in BSF is that a Sub Inspr should not go above the rank of 2 i/c. Why in their case the promotion rules as envisaged by the Govt( Quota- Rata) is not followed? Frankly speaking, our standards and unwritten rules put into practice by prejudices, are poor, discriminatory and biased. You may also suggest possible solutions, besides high lighting the problems, so that the solutions also attract the attention of the decision makers. Reply KHAAS ADMI2 May 2014 09:41 Somehow not happy about the manner in which seeming disparity between medical & rest of BSF cadre has been brought by this otherwise well meaning ex-IG of BSF.
