NPP candidates hold ‘Special Meeting’ Demands cancellation of recent polls, re-election The meeting issued the following resolution which was presided by Shri Harsh Dev Singh, Chairman NPP. The 2nd Session was presided by JKNPP President, Shri Balwant Singh Mankotia Prof. Bhim Sing, Chief Patron NPP moved a resolution which was seconded by Shri Masood Andrabi, State Vice-President JKNPP, Shri Yashpal Kundal President Young Panthers and others. Cancellation of Nov-Dec 2014 Assembly polls in J&K to save democracy 1. There is not an iota of doubt that the Assembly polls were rigged and manipulated by preprogramming the EVMs. 2. That EVMs have been discarded by many democratic countries in the world as not reliable. The countries like Germany, Netherlands and most states in the U.S. have discarded the system as a potential danger of vote fraud and more importantly, lack of transparency and verifiability. The countries like U.K., France, Japan, Singapore have stuck to voting on paper ballot. India initiated use of EVMs in the election which is unconstitutional because it fringes upon the fundamental rights of the citizens and their right to vote. 3. The Supreme Court of India in its judgment on October 8, 2013 has held that, “We are satisfied that the ‘paper trail’ is an indispensable requirement of free and fair elections. The confidence of the voters in the EVMs can be achieved only with the introduction of the ‘paper trail’. EVMs with VVPAT system ensure the accuracy of the voting system. With an intent to have fullest transparency in the system and to restore the confidence of the voters, it is necessary to set up EVMs with VVPAT system because vote is nothing but an act of expression which has immense importance in democratic system.” (Para 29 of the judgment). 4. This election in J&K was held in total violation of the judgment of the Supreme Court of India as the Vote Verifiable Paper Audit Trail (VVPAT) has not been applied by Election Commission of India only to help the Prime Minister Modi and Chief Minister Omar Abdullah to manipulate the general elections held in 2014. a). The Whole World has Discarded Similar EVMs. b). Use of EVMs is Unconstitutional and Illegal Too! c). EVM Software Isn’t Safe. d). …..Nor is The Hardware. e). EVMs are Sitting Ducks. f). “Insider” Fraud a Concern. g). Storage and Counting are Concerns. h). Vote of No Confidence. i). EC is Clueless on Technology. j). Trust Deficit. 5. That the present functioning of EVMs can easily be manipulated by replacing software as it has been done in Gujarat, Haryana and now in Jammu and Kashmir. 6. That entire democracy in India is under a serious threat because of the misuse/manipulation of EVMs in the country. 82% polling in the mountains and 60% polling in the plains in the cities cannot be justified. The victory of BJP candidates in thousands shows the clear manipulation by increasing the margin to discourage the candidates set up by the Panthers Party and other opposition parties. 7. That the present case deserves attention of the democratic forces and the civil society as well as the media that the 15000 EVMs deployed in about 10000 polling stations in J&K were purchased by Election Commission of India from public sector companies say, ‘Bharat Electronics Limited & Electronics Corporation of India Limited’. Mostly from Hyderabad. These machines were moved to Ahmedabad, Gujarat for reprocessing. What does it mean? Does it means that these EVMs were reprogrammed which were used for Gujarat election and later moved to J&K for 2014 election. 8. Election Commission of India in its letter dated August 28, 2014, F.No.51/8/16/9/2014-EMS addressed to Prof.Bhim Singh has admitted that machines were purchased from public sector companies and brought to J&K via Gujarat claiming that EVMs were tamperproof and could not be manipulated. However, Election Commission of India avoided to state as to why these machines were not purchased to a tender etc. EC could not explain why these machines were moved to Gujarat before moving them to J&K. 9. That Prime Minister Modi’s only mission, power, by securing 44 + seats (out of total 87) could not have been realized unless the Panthers Party three sitting legislators were not routed out from the Assembly. Prime Minister Modi dashed his helicopters to every space he got in Udhampur or in Samba. It is the only Panthers Party which has proved to be the best leadership in opposition inside the legislature. The Panthers Party has proved exemplary in handling the administration as a part of the government. Its’ existence in the Assembly was a challenge to the communal politics of BJP and corrupt and authoritarian government of Omar Abdullah. Both wanted to wash out Panthers Party from the Assembly. PM Modi and CM Omar Abdullah succeeded a manipulating/ replacing EVMs in Udhampur and Samba to ensure that NPP legislators were out of the Assembly. Least realizing that NPP leadership shall be more effective than ever before. 10. The Prime Minister made nine helicopters visits to J&K to campaign for his candidates in the state which is a rare chance that Prime Minister of India was campaigning in J&K by the misuse of his authority and finances from the state exchequer. The elections are also void for the reason that Prime Minister alone must have crossed a limit of Rs.100 crores expenses incurred during his visits in his election campaign. 11. The hate speeches made by the Prime Minister and his ministers during the election campaign in J&K creating social and communal conflict among the people of J&K amounted to utter violation of the Model Code of Conduct. Besides, there was gross violation of the Model of Code of Conduct by the Prime Minister and other campaigners during election campaign. The Panthers Party shall take up this matter with the President of India for his intervention for declaring these general elections to the Assembly in J&K as null and void.
