Normally I greatly dislike being at Court. Yesterday I got called to appear in Court for a TRO Violation. At first I absolutely could not recall the case at all. The Prosecutor appeared to be somewhat Happy that I showed up but I was still drawing a blank. He said he is only going to ask me questions about how I measured the distance and had I been trained on the device. I read my report to a certain point and it all came back to me. I measured from the property line to where my suspect was seated and he was within 50, 39 5 to be exact, he admitted knowing he was served the TRO and got arrested. This is the part that irritates me about the Defense Attorney, What was the distance between the building that is the Complainants Shop and the Building that the Defendant was located at? In my mind and what I really wanted to say greatly conflicted because Im on the stand and what they forget is, you asked me to tell the truth, the whole thruth, and nothing but the truth. So in my mind Im trying to suppress a, What the f@ck does that have to do with your client being within 50 of the Complainants place of business. So I replied instead, Maam I measured from the Complainants place of business which would include his property line from the edge of the property to your clients position and your client was within 50 placing your client in violation of the issuing Judges Order. The Prosecutor lowered his head and the Defense attorney started flipping pages while uttering umm uhh, do you remember what kind of identification my client had Officer? Maam thats clearly stated in my report. Oh, um uhh, no further questions at this time your honor! Now Im dumbfounded because Im trying to figure out what the defense was! Doesnt really matter tho.
