Ok FB peeps, lets see if you can help. (And in what ways) On Saturday, 7/12/14 my husband and I were rear-ended on the eastbound right hand lane of the Belt Parkway (right before the Rockaway Parkway exit). The accident occurred somewhere around 2:30-2:40 pm. Heres our version of the story: We were going to the Met game traveling eastbound on the Belt Parkway (my husband was driving). Somewhere around the Paedergat Bridge my husband (a trained driver with over 500,000 safe driving miles) noticed a black Hyundai Suburban swerve right and almost his the wall on the right. My husband was smart enough to try and get away from this guy. He pulled into the right lane (he signaled) to get in front of this guy. Almost a mile later, we are at a near stop (maybe going 2-5 mph in stop and go traffic) when the same black Hyudai hits us. But he doesnt hit us head on from the back; he swerves to (I assume) try and avoid an accident, but his left front hits our right rear. When hubby gets out of the car, the man immediately says, you cut me off. Hubby says no and tells me immediately to call the cops. I did so at 2:43. Just around this time also, someone pulls in front of us in a white suburban. The woman gets out and goes to the man who hit us. The man informs us this is his wife. They both just got off of work. I am on the phone with Geico to call in the claim immediately (while waiting for the cops). The woman goes into the mans car, takes out something and while Im on the phone with Geico I see her spill some kind of rice dish in a takeout container. So the cop shows up and the FIRST thing the man says to the cop is NOT he cut me off its Give me a break man...Im on the job. The man is also insured by Geico so I figure this should be easy. They cannot get in touch with him until Sunday evening to get his side of the story (thats over 24 hrs after the accident) So fast forward to Friday. We go to the 63rd pct. and get the accident report. My husband has been going grayer since the accident...not sleeping..worried; so imagine our combined relief when we see that the accident report SUPPORTS what my husband has been saying all along. That we were stopped in the rt hand lane and he swerved to miss us. We are elated...something is FINALLY going our way. Hubby had to work last night and we were going to fax the police accident report to Geico this morning. Hubby is out at 9 am this morning doing so when he gets a call from Geico. Apparently WITHOUT even seeing the police report, Geico has determined that we were BOTH at fault. SAY WHAT?!?!?!?!?! So heres what I need: 1) I need all my FB friends to send out a post to find out if ANY ONE of their friends were traveling on the Belt Parkway (near the Rockaway Parkway exit) on Saturday 7/12/14 around 2:30 pm and saw an accident involving a black Hyundai Suburban and a green Chrysler Pacifica. I checked my Waze app while waiting for the cops and there were several reports of our accident...Im hoping someone actually SAW it happen. 2) I need anyone who works for or with Insurance companies to let me know what I can do. Should I get a lawyer? 3) I need to know if anyone knows of a lawyer who would handle this type of situation. My husband and I are horribly upset by all of this. We dont sue people...its not who we are. We have BEEN sued and had false claims made against us and have taken it. We just got this car a year ago...were going to be paying for it for the next 4 years. This accident was in NO WAY my husbands fault and I dont think we should be penalized for it. Thanks for any and all help you guys can give me!!!!!
