Any person seeking membership of the Palmar Land’s Committee should have God as his pillar. The Land’s committee should always bear in mind that proceeds from any Palmar Land’s transaction shall be invested in projects concerning: 1. Education 2. Health 3. Infrastructure 4. Cooperative Projects It is how the Land’s Committee, will serve to achieve the main purpose in the benefit of social and infrastructural progress. The removal of any previous By-Laws should be done by the approval, consent, and knowledge of all descendants who wish to participate in public forum style meetings. The amendments of new By-Laws should be done by the approval, consent, and knowledge of all descendants who wish to participate in public forum style meetings. Any descendant can initiate or motion a By-Law either through a Village Councilor, or a member of the Land’s Committee and/or on his/her onus. A legislative Body composed of at least seven villagers, preferably Justices of the Peace shall be the authority to give judgment on the initiated By-Laws in the benefit of the village. The By-Laws should be from time to time revised as not to fall short into antiquity that would render it unbeneficial to the descendants. No member shall ever act alone in any transaction that would involve finance and/or land. No member shall ever hold possession of any bank accounts as a personal purse. If any of the above has been breached at any given time, any descendant can prompt and investigation. Anyone who is known to have committed acts of embezzlement, misappropriation, theft, mismanagement of the village’s funds and/or Land can be liable for public prosecution No Land’s Committee members or assistants of the past, present, and future will go impugned if found guilty of embezzlement, misappropriation, theft, mismanagement of the village’s funds and/or Land. If found guilty of embezzlement, misappropriation, theft, mismanagement of the village’s funds and/or Land any descendant can seek the court of law for the culprit to return all pertinences of the San Jose Nuevo Palmar Land’s Committee and the Village of Palmar to the Committee and Village. Meetings that would involve public funds and land transactions should never be held at private homes, unless it becomes a public venue whereby all descendants are informed and invited to. Any transactions done without the knowledge and consent of the descendants would be rendered null and void. All applications of Land shall be done at set dates in front of the committee and a forum. No one can hold possession of any documents at home as a personal item. No one should hold any blank application forms home with the signatures necessary to acquire land. Handing over should be done with all good intentions of transparency. No one of ill-reputable character may offer him/herself for office. No politics should be involved during the electioneering process of the SJNP LC or at any point. The San Jose Nuevo Palmar Land’s Committee shall not prejudice any descendant because of his/her political affiliation, or creed or difference in opinion. It is illegal to promise land with the purpose of gaining votes for a general election, village council election, and/or the Land’s committee elections. Only descendants should have the priority of land. If necessary to sell or lease land, Descendants must be thoroughly informed and the issue must be debated in an open forum in the benefit of transparency. It is illegal to hold any cash-in-hand greater than $500; therefore, all payments at any given day that would be greater than $500 shall be made to the bank and the receipt should be shown for all transactions on collection day. All other revenues collected during the course of the day set for collections should immediately be registered and sent to the bank; thereafter, withdrawals can be conducted. Withdrawals can only be done by three appointed officers with the official seal of the Land’s Committee and by the consent of the descendants. A detailed explanation for any withdrawal less than $500 must be presented to the committee for approval and to the people for consent. A detailed explanation and feasibility study must be done for the withdrawal of any cash greater than $501. The Land’s Committee should render quarterly audits but must have accounts available for review at any time at the request of any descendant. The Land’s Committee is an entity that should work hand in hand with other major Governing bodies of the Village such as the Village Council, and Water Board. The Land’s Committee will see where suitable to assist any other groups that would request assistance. The Land’s Committee should have a Check and Balance system to ensure that no irregularities occur. A recall system must be set in place to ensure that any member or assistant who is corrupt to be removed. Any descendant can prompt the recall system. Meetings are to be held in a public forum and everyone must be invited by means of public speakers, radio, television, notes or by word of mouth. All descendants are invited to participate, if not, the majority will have to adhere to the decision of a few who made a forum. A forum should consist of all members of the Land’s committee, any member of the other governing bodies, and at least 10% of descendants who can vote. Meetings must be done on days which most descendants can attend. Vulgarities and physical fights will not be tolerated. The person(s) involved in any civil disturbance will be asked to leave the premises of the meeting or adhere to the law. Everyone must be invited to give good, honest, sensible opinions even if it is not in agreement with the committee’s plan. Elections are to be held every two years on the third Sunday of the month of November of every even year (2016, 2018, 2020….and so forth if God permits). No Chair of the Land’s Committee shall serve more than two consecutive terms; however, he/she may offer to participate in another capacity. In the benefit of true democracy, candidates offering themselves for elections shall give their intent on the capacity they see themselves most fit. This will allow descendants to weight independently their candidates and capacities versus having a secret ballot among seven. The SJNP Land’s Committee shall have the freedom to get assistance from any professional in the village for advice or for assistance in order to have the best decision in the best interest of progress for the village. Failure because of ignorance or negligence is not an option. It is illegal. In case a death of voluntary resignation of any member of the Land’s Committee, the forum shall decide if replacement shall be by elections of by a raise of hands.
