Okay-- I just figured it out. Rhodes is laying a case to void the Michigan EM law. Basically, hes suggesting the Michigan Constitution cannot be interpreted to mean that when the people vote in a referendum the legislature can simply enact the same law without any substantive change. What would be the point? Now, can a federal judge rule what the Michigan Constitution means? Yes, when interpreting the Michigan Constitution is needed in order to settle a federal case. And, here we have that situation. Whether or not Orr can file for bankruptcy depends on the validity of the second EM law. If that law isnt valid, he has no standing to file for bankruptcy. Now, you can appeal Rhodes decision. But, that appeal goes up the federal chain all the way to the United States Supreme Court and does not hit the Michigan Courts. Whoops! I guess Snyder did not see that one coming. But then, I bet he is too busy trying to avoid discovery of what his NERD FUND paid for. Check it out, but I bet that is where Rhodes is going and I bet Snyder and Co are scrambling. They saw this coming.
