PRIMER ON THE 2013 BARANGAY AND SANGGUNIANG KABATAAN ELECTIONS SYNCHRONIZED BARANGAY AND SANGGUNIANG KABATAAN ELECTIONS When are the barangay and SK elections held? Barangay and SK elections shall be held on the last Monday of October starting 2007 and every three years thereafter. For 2013, the elections are going to be on October 28, 2013. What are the important dates to remember for the 2013 Barangay and SK elections? Activities Dates Voter Registration (Continuing Registration and Members of Kaipunan ng Kabataan) July 22 – 31, 2013 Aug. 12 (ERB Hearing) Election Period Sept. 28 – Nov. 12, 2013 Filing of COCs Oct. 15 – 17, 2013 Campaigning Oct. 18 – 26, 2013 Election Day October 28, 2013 (7:00 am to 3:00 pm) Filing of sworn statements of election contributions and expenditures Nov. 27, 2013 Reference: Comelec Reso No. 9715 Who can register as members of Katipunan ng Kabataan and what are the requirements to be submitted? (Reference: Comelec Reso. 9717) Any Filipino citizen who is: 1. At least 15 years old but less than 18 years old on election day; 2. actually residing in the barangay for at least 6 months on election day and 3. not otherwise disqualified by law may be registered as members of the Katipunan ng Kabataan. In filing his/her application for registration, the applicant may present any of the following documents: 1. Certificate of Live Birth; 2. Baptismal Certificate; 3. School Records; or 4. Any other document that will establish the identity and other qualifications. What are the officials to be elected and their qualifications? ( Ref: 2010 Comelec Reso. 9029) Barangay Elections One (1) Punong Barangay; Seven (7) Sanguniang Barangay Kagawad • Filipino citizens; • At least 18 y/o on election day; • Able to read and write Filipino or any local language or dialect; • Registered voters of the baragay where they intend to run for office and residents thereof for at least one (1) year immediately preceding the day of the election. SK Elections One (1) Chairman; Seven (7) SK Kagawad • Filipino citizens; • At least 15 years old but less than 18 years old on election day; • Able to read and write Filipino or any local language or dialect; • Qualified members of the Katipunan ng Kabataan* of the barangay where they intend to run for office and residents thereof for at least one (1) year immediately preceding the day of the election; • Must have not convicted of a crime involving moral turpitude. Reference: Comelec Reso. 9029 Who are disqualified from running for any elective Barangay and SK positions? (Reference: Comelec Reso. 9029) 1. Those sentenced by final judgment for an offense involving moral turpitude or for an offense punishable by one (1) year or more of imprisonment, and within two (2) years after service of sentence; 2. Those removed from office as a result of an administrative case; 3. Those convicted by final judgment for violating the oath of allegiance to the Republic; 4. Those with dual citizenship unless at the time of filing of the certificate of candidacy, unless he makes a sworn renunciation of any and all foreign citizenship before any public officer authorize to adminster an oath ; 5. Fugitives from justice in criminal or nonpolitical cases here or abroad. A fugitive from justice includes not only those who flee after conviction to avoid punishment but likewise those who, after being charged, flee to avoid prosecution; 6. Permanent residents in a feoreign country or those who have acquired the right to reside abroad and continue to avail themselves of the same right after the Local Government Code; 7. The insane or feeble minded; 8. Any candidate who, in action or protest in which he is a party , is declared by final decision of a competent court to be guilty of having, or is found by the Commission to have committed the following acts shall be disqualified from continuing as a candidate or, if already elected, from holding office: a. Given money or other material consideration to influence or induce voters to vote for or against a candidate, or to abstain from voting, or to corrupt government officials and employees performing election functions; b. Committed acts of terrorism to enhance his candidacy; c. Spent in his election campaign an amount in excess of that allowed by law; d. Solicited, received or made any contribution prohibited under Secs. 89, 95, 96, 97 and 104 of the OEC; e. Violated any of Secs. 83, 86 and 261 (pars. e, k, v and cc, sub.par. 6) of the same Code; f. Those who have been elected and served for three (3) consecutive terms in the same position. Voluntary renunciation of office for any length of time shall not be considered as an interruption in the continuity of service for the full term for which the elective official was elected. What is the effect of filing certificate of candidacy? (Reference: 2010 Comelec Reso. 9052) Appointive barangay, city/municipal, provincial, regional or national officials or employees or those in the civil or military service, including those in government-owned or controlled corporations, shall be considered ipso facto resigned from office and must vacate the same at the start of the day of the filing of his certificate candidacy for a barangay or sangguniang kabataan office. For incumbent municipal, city, provincial, and national elective officials running for any barangay elective position shall not be considered resigned upon the filing of their certificates of candidacy. Non-partisan Character of the Barangay and SK Elections: No person who files a certificate of candidacy (COC) shall represent or allow himself to be represented as a candidate of any political party or any other organization; and no political party, political group, political committee, civic, religious, professional, or other organization or organized group of whatever nature shall intervene in his nomination or in the filing of his COC or give aid or support, directly or indirectly, material of otherwise, favorable to or against his campaign for election. Provided, That this provision shall not apply to members of the family of the candidate within the fourth civil degree of consanguinity or affinity nor to the personal campaign staff of the candidate in his barangay. Nothing in this Section however shall be construed as in any manner affecting or constituting an impairment of the freedom of the individuals to support or oppose a candidate for any barangay office. ELECTION CAMPAIGN Reference : 2010 Comelec Reso. No. 9043; Sec. 38 BP 881; Expenditures: No candidate shall spend for his election campaign an aggregate amount exceeding Five Pesos (P 5.00) for every registered voter in the barangay where he seeks to be elected. Statement of Contributions and Expenditures (SOCE): Every candidater shall file with the OEO where he filed his COC a full, true and itemized statement of contributions and expenditures in connection with the election. Recommendation It is strongly recommended that this material be the basis of your replies to queries from the general public during the run-up to the resumption of voter registration, on the 22nd of July 2013. It is further strongly recommended that this information be printed out and be made available to the general public in the most cost-efficient and labor-efficient means possible, APART from publication on your Facebook account if possible.
