PTIs 6 POINT DEMAND – MEANINGFUL SUGGESTIONS – PART 2 In Part 1, the 6 point demand of PTI was presented with a very short analysis of each point. The main issue to be decided is the rigging of the 2103 elections. Everyone says that there was rigging, but no Constitutional or acceptable remedy can be provided unless that is proved. The announcement of a Supreme Court Commission to investigate this, WILL NOT WORK. PTI has charged members of the judiciary in being involved in the rigging. The ex Chief Election Commissioner (Fakhruddin G. Ebrahim), resigned stating that there was too much judiciary interference in performance of his duties. SO THE MAIN ISSUE IS INVESTIGATION OF THE RIGGING AND NOT THE RESIGNATION OF THE PM. If rigging can be proved, than resignation of the PM and dissolving of the assemblies (Articles 58 and 112) can be constitutionally implemented. Re-elections are than automatic. Removal of the Election Commission members under Articles 215(2) and 209 can be implemented even without the parliament. A parliamentary committee is already working on electoral reforms (though we feel that the chairman of that committee should not be from the govt. and a PAT member MUST be co-opted in). Although forming a new Election Commission and a caretaker govt. without a parliament will be a challenging task under the Constitution, our party has a solution for that, which I will present in a later part of this Article. As noted in Part 1 of my article, there is no debate on taking action under Article 6 against people involved in the rigging, if proved.
