Patent Infringement Suit Likely to Proceed Radio World (07/22/13) Stine, Randy J. Mission Abstract Data/DigiMedia has asked U.S. District Court Judge Leonard Stark to lift the stay on its patent infringement lawsuit that has been in place since November 2011 pending the conclusion of several patent reexaminations. The suit was filed against several major radio groups, including Beasley Broadcasting, CBS Radio, Cox Radio, Cumulus, Entercom, and Greater Media, and is directed at the digital media storage and automation systems used by the broadcasters. The filing of a U.S. Patent & Trademark Office Notice of Intent to Issue Reexamination Certificate of July 8 suggests that the majority of the patent claims are allowable over the prior art asserted in a second reexamination. Scott Daniels, an intellectual property attorney not involved with the case, said that the filing clears the way for the judge to set a trial date in the suit, and added that "whether [the suit] actually is a win depends on if the surviving claims are the commercially significant claims." He also added that it would take several months for patent reexamination certificates to be issued.
