Personally I think there should be two maybe three types of patents. The first being the innovator patent where you have to prove that your design/concept is unique and non-derivative which allows for sole ownership and lifetime rights to a design. The second is a derivative patent where your design/concept is only achievable due to the successes of others in the same field or related uses where this should be a limited scope patent that only allows for say a 5 year non-renewable patent and the third being a finish line patent that recognizes many players in a field but you happened to get there first that covers say one to two years of exclusive right.
