RIGHT TO HEALTH COMES UNDER ARTICLE 21 OF CONSTITUTION OF INDIA BUT THIS RIGHT WAS DENIED BY DISTRICT HEAD QUARTER HOSPITAL, PURI, ODISHA. Dear All As per the news published in Metro page of daily odia news paper “DHARITRI” dated 01.10.2013 one poor patient was thrown out of District Head Quarter Hospital, Puri without treatment and operation as he could not be able to pay bribe Rs 3,000 (Rupees Three Thousand) to the medical staff prior to operation. The patient named Kailash Roul, aged about 50 years of Chhaitana Village, Puri Sadar was admitted in Surgical Ward (Bed No. 120) of District Head Quarter Hospital, Puri on 20.9.2013 for treatment and operation, the Medical Staff demanded bribe Rs 3,000/- from him for Operation but his son could able to manage only Rs 500/- hence the above mentioned patient was denied operation by the doctor and immediately he was given discharge from the hospital. It iscomplete violation of Article 21 of Constitution of India. I (being the Public) am going to instruct the C.D.M.O of District Head Quarter Hospital, Puri(Public Servant) to investigate the incident and provide me the copy of the investigation report so that I can take appropriate action against the erring doctor and medical staff. It is not yet understood under which condition and circumstance the patient was discharged from the hospital without proper treatment and operation, because of which he was being deprived from his Constitutional right under Article 21 of Constitution of India. The Constitution guarantees the some fundamental rights having a bearing on health care. Article 21 says “No person shall be deprived of his life or personal liberty except according to procedure established by law.” Right to live means something more than animal existence and includes the right to live consistently with human dignity and decency. , Honourable Supreme Court of India explicitly held that the right to health is an integral factor of a meaningful right to life. The court held that the right to health and medical care is a fundamental right under Article 21 of Indian Constitution.
