Supreme Court’s Law and presenting Concealed Truth in your order dt.3.5.2014 in R.C.S.No.19/2014 & in O.M.A. 55/2014 and also showing “Deplorable Standards of Judicial system” as per the findings given by Hon. Supreme Court in case of Santosh Kumar Singh vs. State through CBI- ( 2010)9SCC747 “Though I know he is the man who committed the crime, I acquit him, giving him the benefit of doubt”. + Fraud on Court I, the undersigned, Ms.Roshani S.Bafna,age 53 years, do hereby serve upon you this notice as under: 1. That I filed Regular Civil Suit being No.19/2014 before Your Honour for setting aside the order dtd.13.4.2004 in RCS No.1/2004 .In said suit I brought to your Honours kind perusal the facts regarding the landed property at village Sarwli@Manfod which is gifted & bequeathed to me by my late mother Smt.Udayprabha S.Bafna for my survival. I also brought to Your Honours kind notice that the builder Vijay Ghodawat@Shah has obtained the said order within 4 month by fraud on Court on the basis of false,forged & fabricated revenue record of my aforsaid landed property, without making me a party in said suit by him with ulterior motive to grab my landed property. I also filed O.M.A.55/2014 for direction to Dahanu Police u/s 156(3) of Cr.P.C. for investigation & to register FIR against accused as regards forged,false,fabricated revenue record of said landed property ,wherin I brought to your Honor’s kind perusal the original revenue record of said landed property owned and possessed by me and also brought the case law of Hon.SC Court in Lalitakumari vs.State of Up & ors.which says it is mandatory on police to register the FIR. Your Honor has perused the said false ,forged and fabricated 7/12 extracts and the original 7/12 extracts of my said landed property and satiesfied by the truth placed by me through aforsaid suit and Cr.Application filed by me before Your Honor. But Your Honor has not only given diplorable standard of Judicial system but also violated the directions laid down by Hon’ble Suprem Court of India in Santosh Kumar Singh vs. State through CBI- ( 2010)9SCC747 “Though I know he is the man who committed the crime, I acquit him, giving him the benefit of doubt”. You had further committed the following illegalities , contempt of Hon’ble Supreme Court as well as Hon’ble High Court and also committed various offences under various sections of the I.P.C. which are mentioned as under: 2. That as you being Ld.Magistrate, you are supposed to represent, work for and on behalf of impartial judiciary system and not for supporting the forgery ,and on the basis of it grabbing of victims livelihood ,a serious offence committed by accused builder. However, without valid reasons you have supported to forgery for which I require reasons from you and it is also a matter of serious consideration. 3. As per the Law, Indian Judiciary is supposed to Safeguard and Protect the Life, Liberty and Human Rights of Victims, that is me and also more sounder 53 years old lady victim suffered from various ailments like T.B.,hyper acidity, severe back ache,vertigo,shoulder pain,thyroid, etc. and lost her all teeth in her young age as she had suffered cruelty at the hands of her greedy in-laws and husband who made her to run from pillar to post for 12 years to get her return back of stridhan from Family court,Bandra, inspite of confirmation of issue of Cruelty on wife and misappropriation of her gold ornaments & valuables by her husband & in-laws, in its verdict dt.21.8.1992 in FCA No.37/92 filed by my husband before Hon’ble High Court, Bombay. Thereafter also the amount invested by me through brokers was also grabbed by cheating to me, and this Hon’ble Court without respecting to evidence on record of the court,& without hearing to me, aqcquitted the accused ,thus again since last 10 years I have been made to run in various courts. 4. Unfortunately,during this period the builder has filed a suit being.R.C.S.No.1/2004 before this Hon’ble Court who obtained the order within 4 months in his favor & got declared as a owner in the landed property gifted & bequathed to me by my late mother, on the basis of false,forged and fabricated revenue record though he has not made me a party in said suit. Thus my livelihood has been deceitfully snatched, and made to run from pillar to post since then. It is submitted that except said landed property I have no source of income from any angle. Thus I am compelled to take huge loan from friends & relatives for my survival. The suit filed by me before Your Honor to restore my landed property and brought the facts how the builder has obtained the order by fraud on court which needs to be set aside. But without hearing on merit of the case Your Honour has denied my right to be heard on merit and thus violated the law laid down by Hon’ble Supreme Court. Your Honor while allowing the frivilious application dt.10.4.2014 filed by the builder,has not only failed to consider the facts placed by me in my reply dt.10.4.2014 but Your Honour has conceled the truth of existance of my said reply which certainly amounts to fraud on court and contempt of your own court as well as contempt of Hon’ble Suuprem Court as per the law laid down in case of Union of India vs. Ramesh (2012)1 SCC 476 laid down that judgment obtained by non-disclosure of all necessary facts tantamount to a judgment obtained by Fraud. And you are Guilty of playing Fraud on Court. Thus against this grave injustice on me I shall peacefully protest this by fasting till I get justice or till my death. I also brought these facts to the kind notice of Hon’ble CJI ,Supreme Court of India,Hon’ble CJ,High court,Bombay,& Principle Judge at Thane.
