Bassetlaw District Council sets your rent. All councils use the same way of working out rents by using a Government formula. Your rent is based on the following: Average Earnings Lower average local earnings will mean that a tenant living in Bassetlaw will pay less rent than a tenant living in London Property Values A tenant living in an area where property values are high will pay more rent than a person living in an area where values are lower Number of Bedrooms The more bedrooms your property has, the higher the rent Why is my rent more than my neighbours-even though our homes are the same? The current rent charged for your home depends on the rent that was being charged in 2002/03 when the new rent setting policy came into operation. Before then, rents were set in a different way which could have resulted in differing rent levels for properties of a similar size. This is because other factors used to be taken into account, such as improvements to heating systems, and window and door replacements. As a result, if neighbouring properties had different rents in 2002 they will continue to be different (although the gap will reduce each year) until the target rents are reached in 2012. What are rent arrears? If a tenant misses payments, makes part payments or pays late they are said to be in rent arrears. Rent arrears are a debt. As you are charged a weekly rent, due each Monday, if you choose to make fortnightly or monthly payments these should be made IN ADVANCE to avoid arrears on your account and reminders being sent to you. This is the first stage of legal action which allows a landlord to apply for the possession of a tenants home. Usually a Notice of Seeking Possession is served when a tenant is more than 4 weeks in rent arrears and legal action is being considered to recover the debt. If you have been served with a Notice you should contact an Income Recovery Officer immediately to discuss how you will clear the arrears and avoid further legal action being taken. If after 28 days, of a Notice being served, the arrears have not cleared or an agreement is not being maintained to satisfactorily reduce the arrears you will then be at risk of losing your home as the next stage in legal action would be to apply to the Court for a Possession Order. If Court action is taken any costs incurred are payable by the tenant. If I dont pay after a Court Order will I be evicted? Yes, if you fail to keep to the Order, we can apply to the Court for an Eviction Warrant. We will contact you before we do this to see if we can help, but tenants who persistently do not pay their rent will be evicted. If you are having problems paying your rent it is important that you contact us immediately. Ignoring the problem doesnt make it go away. Will the Council rehouse me if Im evicted for rent arrears? No, if you are evicted for rent arrears and then present yourself to the Council as homeless, it is likely that the Council will say you are intentionally homeless and, therefore, does not have a duty to rehouse you. What will happen if I leave my property owing rent? As you are still liable to repay any oustanding rent owed we will contact you to negotiate a suitable repayment plan. If you do not pay off the oustanding rent we will refer the case to a Debt Collection Agency who will write and visit you to collect the arrears. If this is unsuccessful we will consider taking legal action to recover the debt. Former tenants who owe rent arrears will not be eligible for rehousing by Bassetlaw District Council unless they have cleared the debt or demonstrated a commitment to paying off the debt.
