A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. 2. ELIGIBILITY: “ESPN Mint Condition Facebook Fan Giveaway ” (Sweepstakes) is open to all legal residents of the 50 United States and the District of Columbia (EXCLUDING PUERTO RICO, OTHER UNITED STATES TERRITORIES, AND FOREIGN TERRITORIES), age 13 years or older as of the date of entry, who have an active Facebook account. The following are not eligible for the Promotion: (i) employees and agents of Sponsor and their respective parent, subsidiary and affiliated companies, and each of their respective advertising/promotion agencies; and (ii) the immediate family members and/or household members of any of the persons set forth in (i) above. Immediate family members shall mean parents, step-parents, children, step-children, siblings or spouses. Sweepstakes is governed by U.S. law and subject to all applicable federal, state and local laws and regulations. SWEEPSTAKES PERIOD: Enter between September 24th, 2014 at 6:30 pm and September 26thth, 2014 at 7:00 pm (the Sweepstakes Period”). 5. HOW TO ENTER: During the Sweepstakes Period, access the ESPN Mint Condition Facebook page at facebook/espnmintcondition (“Website”) and click the “Like” button to become a fan of ESPN Mint Condition. Then, “Share,” and “Comment” on the designated ESPN Mint Condition Show post to be entered for one entry to the Sweepstakes. Only one entry per person regardless of the number of registered Facebook accounts. Entries generated by script, macro or other automated means will be void. The Sponsor is not responsible for misdirected, incomplete, lost, late, illegible, undelivered, inaccurate or delayed entries, or for technical, hardware, or software failures of any kind, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmissions or other errors or problems which may limit or affect a persons ability to participate in the Sweepstakes, whether human, mechanical, typographical, printing, electronic, network or otherwise, relating to or in connection with the Sweepstakes, including, without limitation, errors which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the prize or in any Sweepstakes-related materials. In the event of sabotage, acts of God, terrorism or threats thereof, computer virus or other events or causes beyond the Sponsors control, which corrupt the integrity, administration, security or proper operation of the Sweepstakes, Sponsor reserves the right, in its sole discretion, to modify, cancel or suspend the Sweepstakes. In the event of cancellation, Sponsor reserves the right to award the prize from among all eligible, non-suspect entries received prior to the event requiring such cancellation. False or deceptive entries or acts will render the participant ineligible. 5. HOW TO WIN: A random drawing of all eligible entries received will be conducted by representatives of Sponsor in order to determine the winner. If a potential Winner cannot be reached, is found to be ineligible, cannot or does not comply with these Official Rules, or if Prize (defined below) or Prize notification is returned as undeliverable, such potential Winner will be disqualified and time permitting, at Sponsor’s sole discretion, an alternate potential Winner may be selected in a random drawing from the remaining eligible Entries received during Sweepstakes Period. All decisions of Sponsors and their representatives are final and binding with respect to all matters related to the Sweepstakes. 6. PRIZE: One winner will receive a 20-card lot of trading cards and another winner will win a 3-card lot of Topps Triple Threads hits. APPROXIMATE RETAIL VALUE (ARV) OF PRIZE $100.00 (20-card lot) and $45.00 (Triple Threads lot). TOTAL ARV OF ALL PRIZES: $145.00. 7. PRIZE RESTRICTIONS: Sponsor reserves the right to substitute for any reason whatsoever a prize (or portion thereof) of comparable or greater value, at its sole discretion. Prize is awarded as is with no warranty or guarantee, either express or implied by Sponsor. THE WINNER IS SOLELY RESPONSIBLE FOR THE REPORTING AND PAYMENT OF ALL FEDERAL, STATE AND LOCAL TAXES (IF ANY) ASSOCIATED WITH THE ACCEPTANCE AND USE OF THE PRIZE. All costs and expenses relative to acceptance of the prize and participation in Sweepstakes not specified herein are not included and are solely the Winners responsibility. PRIVACY AND PUBLICITY: All information submitted by participants in the Sweepstakes will be treated according to the Privacy Policy, available at espn. Except where prohibited, participation in the Sweepstakes constitutes participants consent to the Sponsors use of his/her name, likeness, voice, opinions, biographical information, and state of residence for promotional purposes in any media without further payment or consideration. 9. GENERAL RULES AND REGULATIONS: By entering this Sweepstakes, each participant grants Sponsor and its designees the right, unless prohibited by law, to use his/her name, city and state of residence, voice, picture and likeness, without compensation, notification or approval, for the purpose of advertising and publicizing the goods and services of the Sponsor and all matters related to the Sweepstakes, in any manner or medium, now or hereafter known, throughout the world in perpetuity. The potential Winner must respond to initial winning notification within 24 hours of receipt. The potential Winner may be required to execute an affidavit of eligibility, a liability release, a tax acknowledgment form and, except where prohibited by law, a publicity release and return them within two (2) business days of issuance. ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR, WHOSE DECISIONS ARE FINAL. SPONSOR SHALL SOLELY DETERMINE ANY FORM OF VERIFICATION. MINORS: If a potential winner is a minor in his/her jurisdiction of primary residence, potential winners parent/legal guardian must execute all documents and agree to all obligations and undertakings required of the potential winner in these Official Rules, both on behalf of himself/herself and the potential winning minor. Prize may be awarded in the name of, or to, parent/legal guardian. Legal guardian must be at least 18 years old. 11. RELEASE AND INDEMNITY: By participating in this Sweepstakes or receiving a prize, entrants (and in particular, winners) agree to release and to indemnify and hold harmless Sponsor, Facebook and each of their respective related companies, and all of their respective officers, directors, employees and agents (collectively, the Released Parties) for any liability, injury, death, loss or damages to entrant or any person or entity, including without limitation damage to personal or real property, caused in whole or in part, directly or indirectly, by participation in this Sweepstakes (or related activities) or the acceptance, possession or use/misuse of a prize. 12. LIMITATIONS OF LIABILITY: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment, hardware, software or programming associated or used with the Sweepstakes; (2) technical errors, defects, delays or failures of any kind, including without limitation malfunctions, interruptions or disconnections in communications lines, Internet or website access, hardware or software; (3) digital or electronic disruptions, e.g., viruses or other security breaches; (4) unauthorized human intervention, e.g., hacking; (5) technical or human error which may occur in connection with any aspect of the Sweepstakes; (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrants participation in the Sweepstakes, access to, copying or downloading materials from Facebook or any other website, or receipt or use of any prize. 13. DISPUTES: Participant agrees that: (a) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for or the appropriate State court located in New York, (b) all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes but in no event attorneys fees, and (c) under no circumstances will participant be permitted to obtain awards for and participant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
