That’s what came to mind when I read an email stating that the California 9th Circuit Court of Appeals agreed with school officials at Live Oak High School who in 2010 ordered students wearing shirts that displayed the American flag to turn them inside out -- or get expelled. And why were these shirts ordered worn this way, these students’ First Amendment rights impeded and the threat of expulsion made? Owens asks. So that Latino students celebrating Cinco de Mayo wouldn’t be offended at the sight of the shirts, become enraged and attack the students. Salena Owens explains the logic of this ruling: The court said fears of racial violence by students outraged over the American flag displayed on the T-shirts outweighed the right guaranteed by the Constitution. Read it closely: fears of racial violence . . . outweighed the right guaranteed by the Constitution. This means: California school officials -- and the court -- caved to bullies and surrendered the right to free speech as protected under the Constitution. The example set for the flag-wearing students was to submit to intimidators because school officials do not have your back. And in this case, neither does the court. Your free speech won’t be tolerated; however, harmful threats made by angry bullies will not only be tolerated, but also protected by the court. What did the court say? fears of racial violence . . . outweighed the right guaranteed by the Constitution. Those who break the rules of freedom will be broken by the rule of extremist.
