Sellers of homes - Generally you do not have a duty to disclose latent defects (things not reasonably known or seen by inspection) unless you knew about them and they pose a risk to safe occupancy. However, if you actively conceal a latent defect from a buyer, particularly if it affects safe or reasonable living by the buyer, you could have a problem. Speak to a qualified lawyer before you sign your deal - always a good idea and might save you a lot of potential legal expense.
