I received this reply from the QBCC today, they are taking over from the QBSA. I requested info on the new laws and exactly how, would you be considered an associate & risk having your licence renewal refused or cancelled ....this is their response..... Dear Ms Robbins, Thank you for your email of 16 January 2014 regarding the changes to the licensing laws which could affect licensees who are identified participants in criminal organisations. The new licensing laws will apply to trade contractors and builders who are licensed with the Queensland Building and Construction Commission (QBCC) under the Queensland Building and Construction Commission Act 1991 (the Act). The QBCC does not regulate electricians, but the new licensing laws will potentially affect electricians licensed with the Electrical Safety Office. The amendments mean that a person who is an identified person in a criminal organisation will no longer be a fit and proper person to hold a licence with the QBCC or to control a licensed building company. When the new laws commence operation, the Queensland Police Service will conduct criminal gang checks on builders and trade contractors licensed with the QBCC as part of the licence application and licence renewal process. The changes mean that the QBCC will be required to refuse a licence application or to cancel an existing licence for anyone who the police commissioner identifies as a participant in a criminal organisation. The Queensland Criminal Code and regulations outlines which organisations are ‘criminal organisations’ as well as what constitutes being an ‘identified participant’ or an ‘associate’ of a criminal organisation. The definitions are very broad and include any person who is associated with a criminal organisation in any way or anyone who declares, asserts or advertises their membership or association with a criminal organisation. The Government has not set the date for the commencement of the new licensing laws yet. They will probably commence on 1 July 2014. Unfortunately, the QBCC cannot answer your queries about what is expected of tradesman in terms of proving they are not an associate or participant of a criminal organisation. The police commissioner and the Queensland Police Service will determine who is an identified participant of a criminal organisation and will advise the QBCC who is not a fit and proper person to hold a licence. The QBCC will then be required to refuse the licence application or cancel the existing licence based on the information supplied by the police commissioner and the Queensland Police Service. If the QBCC cancels a licence under these new laws, the person affected by the decision will be able to appeal the decision to the Queensland Civil and Administrative Tribunal (QCAT).
