Situation 1. I point a gun at a person, pull the trigger, and the bullet kills the man. Situation 2. I point a gun at a person, pull the trigger, and the bullet misses the man. Why would the punishment be different just based on the quality of my eye sight? If the intent is the same and the conduct is the same, why would the punishment be different? I submit that any answer indicates we do not have a rehabilitation system because the rehabilitation would be based on the intent and conduct, not the outcome. Instead, we have a punishment system.
