Social dialogue as an instrument of representing and protecting the rights and interests of employers and their participation in socio-economic issues in the Odessa region Based on the requirements of the Law of Ukraine On the employers organizations, their associations, rights and guarantees of their activity, along with the main objectives to ensure the representation and full protection of the rights and legitimate interests of employers, Association of Organizations of Employers of the Odessa Region (AOEOR) in their everyday work is paying attention to the participation in the formation, implementation and management of economic, social, labor relations, promoting socio-economic development of the Odessa region. According to the international and domestic experience, in order to ensure sustainable socio-economic development and stability in society is possible only when there is a close interaction, constructive cooperation of the authorities, local governments, employers and trade unions. Only because of these positions the Association of Organizations of Employers of the Odessa region during the formatting of its operational work is implementing the realization of the statutory objectives, the requirements of laws and regulations relating to the operation and protection of the interests of employers. Among the methods of social dialogue, special attention is paid by our Employers organization to the preparation, conclusion and implementation of the Regional Agreement between the Association of Employers (AOEOR), Odessa Regional State Administration and the Federation of Trade Unions of the Odessa region. In the preparation of the actual Regional Agreement, employers contributed more than 20 specific proposals in its content, in order to support regional producers, to create the conditions for improving the competitiveness of the real sector of the regional economy, energy, economic growth, investment and innovation activities of enterprises, to create new jobs, business development, to protect the interests of employers, to raise the living standard of the employees, etc. The realization of the Regional Agreement is under the constant control of the Association of organizations of Employers of the Odessa region and twice a year (on the results of work for six months and an year) is considered at a meeting of the Regional Tripartite Social and Economic Council (hereinafter the Tripartite Council), that is consisting of 15 representatives from each side of the social dialogue. The daily systematic work of the Tripartite Council, that is acting in accordance with the work plan agenda for the calendar year that is formatted under the active participation of Association of organizations of Employers of the Odessa region, is helping in the everyday realization of the basics of the Social Dialogue in the region. The Tripartite Council is disputing and studying all the questions and problems and making appropriate decisions and decrees of advisory actions on it, that are can be accepted for the implementation in legal way or be refused by all structures of territorial authorities, including Odessa regional State Administration as well. Therefore, the Association of organizations of Employers of the Odessa Region in everyday work pays special attention to the state of implementation of the Tripartite Council’s decrees and decisions. The Association also provides materials and acts as a speaker on many issues during the meetings of the Tripartite Council. For example, in June 2013 we initiated the issue of strengthening social dialogue at the level of regional districts and cities of regional importance. On this subject the work is under the implementation today, as from the part of local administrations and mayors, and from the Association as well. Nowadays, thanks to effective control over the implementation of decisions of the Tripartite Council of the Odessa region, two regional employers organizations have been established. In districts and cities of regional importance were created a social and economic councils, where they never been before, and were updated where they already been operated, and were improved their work (regular meetings, the quality of decisions, etc.). Along with the implementation of regional agreements and participation in the work of the Tripartite Council, the Association of Employers (AOEOR) focuses on cooperation agreements with the territorial divisions of the central executive authorities, social security funds, regulatory and fiscal authorities. As of December 31st, 2014, such agreements have been concluded with eleven key structures in the Odessa region. Such cooperation with regulatory, fiscal authorities, social security funds helps avoid bias attitude of these bodies to the employers in the implementation of scheduled and unscheduled inspections, ie protection from employers misconduct. Does not remain without our attention such form of interaction with the regional state administration and territorial divisions of the central executive authorities, as the participation of representatives of the Association of Employers in the boards, councils, committees and other working bodies and boards. Today, our representatives are the members of 16 such working bodies, and by the way, our chairman of the board of the Association of Employers is co-chairman of the Regional Tripartite Social and Economic Council, chairman of the Public Council of the State Fiscal Service in Odessa Region, deputy chairman of the Economic Council of the Odessa mayor. As a result of the implementation of social dialogue through the conclusion of the Regional Agreement between the Association of employers (AOEOR) with State Regional Administration and the Federation of Trade Unions of the Odessa region, membership and active participation of the Association of Employers (AOEOR) in the Regional Tripartite Social and Economic Council, boards, commissions and other working bodies and boards at the regional state administration, territorial subdivisions of central executive bodies is an effective mechanism to ensure the representation and protection of the rights and legitimate interests of employers before the government, local authorities, trade unions and other civil society and public organizations, to attract employers to implement a regional program for social and economic development, improving the living standards of workers.
