The court also directed all the parties to meet on November 14 and discuss the modalities to implement the export ban, and report the developments to it on November 22. On October 17, the Indian apex court passed an interim order to the Union of India and state governments of Bihar, Uttar Pradesh, Uttarakhand and West Bengal, from where a majority of the animals are transported, to prevent ‘illegal transportation’ across the border. “We direct the respondents to ensure that no live cattle and buffaloes are exported out of India into Nepal, but under licence,” read the order, Complying with the order, the Home Ministry have issued necessary directives to the Armed Border Force and Indian Police, which are attached here with as ready reference, where as Animal Welfare Party along with OIPA - Indian People for Animals shocked to know that AWBI seems to be silent on this issue, hence AWBI along with AWD is here by requested to please ask all Chief Secretaries, Director General of Police, District Magistrate along with Superintendent of Police to prepare action taken report, appoint Duty Magistrates, Nodal Officers to monitor and coordinate on the control of the illegal movements of the animals towards Nepal, besides it AWBI may prepare a list of activists ready to work as volunteers and then asked the concerned Police Authorities to equipped them with Police powers, under section 34 of the Prevention of Cruelty to Animals Act, 1960. It would also be pertinent to mention here that Ministry of Environment and Forest may kindly bring ordinance making all kinds of offenses against animals, be cognizable in legal terms along with non bailable offense, like wise Infirmaries under section 35 of the said Act be functional, to keep animals during court trials, where as we have taken up the matter with the Ministry of Roads and Highways, to amend the Motor Vehicle Act, draft rules will be on their websites in a couple of days for public comments. It is further intimated that Ms.Urvashi Prasad alerted me that following District Authorities are not aware about the Court orders: Pithoragarh, Champawat, Rudrapur, Pilibhit, Lakhimpur Kheri, Bahraich, Sravasti, Balrampur, Siddarthnagar, Maharajgunj, Kushinagar, West Champaran, East Champaran, Sitamarhi, Madhubani, Supaul, Araria, Kishangunj, Darjling, North District (Sikkim),West District (Sikkim) and so on all bordering areas of Indian territory, hence AWBI may prepare demi official letters for all concerned enforcement agencies and they failed to perform their official duties then responsibilities be fixed on the public servants and adverse remarks be recorded in their annual confidential reports, all bordering areas animal rights activists along with the NGOs may kindly be asked to approach local Chief Judicial Magistrate to pass appropriate orders for strict compliance of the orders passed by the Supreme Court of India, it is further intimated that Supreme Court of India also passed an remarkable order in CWP No. 309 of 2003 about animal transportation, based on Cattle Transport Rules, 1978 amended in 2001 read with the order passed in the Jallikattu matter., where as I offer my services to AWBI and AWD to work as Nodal Officer, to coordinate each and every movement, to control illegal animal movement towards Nepal, it would also be pertinent to mention here that AWBI may kindly be release advertisement in the leading news papers, through agencies for print and electronic media about illegal animal movement, handbills, hoardings etc publicity measures also be utilized to aware public about their Constitutional duties, as defined under article 51 A (g).
