Rick Perry Contemplates Secession Monday, October 7, 2013 That is why I am here today to express my unwavering support for efforts all across our country to reaffirm the states’ rights affirmed by the Tenth Amendment to the U.S. Constitution. I believe that returning to the letter and spirit of the U.S. Constitution and its essential 10th Amendment will free our state from undue regulations, and ultimately strengthen our Union. The legislation itself (HCR 50) declares the state sovereign and demands “[t]hat all compulsory federal legislation that directs states to comply under threat of civil or criminal penalties or sanctions or that requires states to pass legislation or lose federal funding be prohibited or repealed.” This isn’t your garden-variety conservative rhetoric. It’s actually considerably more radical than that. The Civil War (and, if that’s not enough, a subsequent Supreme Court decision) makes clear that secession is illegal. Beyond that, the Texas resolution (though silent on secession per se) appears to buy into the similarly discredited theory of ‘nullification’–the idea that states are sovereign and can pick and choose which federal laws apply to them. This is illustrative, I think, of a problem that, in the United States at least, seems to particularly afflict conservatives–specifically, that even brief electoral reverses make it difficult for mainstream Republican politicians (like Perry), and members-in-good-standing of the conservative movement, to steer clear of the line between loyal opposition and truly fringe ideas. You saw a flash of this when Rep. Michelle Bachmann (R-MN) said she wanted Americans to be “armed and dangerous” against energy reform, then quickly walked it back, and in other instances as well. And he does say that at one point in his talk with Chris Matthews that Texas can’t secede. But then he has a reading of the 1845 annexation of Texas in which he claims that Texas can essentially force Congress to kick them out of the Union, thus amounting to a sort grand secessionist bank-shot. Here’s the quote … Texas as a Republic joined the Union by treaty. There’s a process in the Treaty by which Texas could divide into five states. If we invoke that, the gov … the United States Senate would kick us out and nullify the Treaty. They’re not going to allow ten new Texas senators into the Senate. That’s how you secede … A few seconds later DeLay seemed to say Texas couldn’t secede but then went back to the Treaty double-bank shot idea. I guess you could say he’s conflicted. Just abandon Social Security altogether and let the states handle it. Texas (of course) has already fixed Social Security’s problem, Perry says, so why should it be saddled with paying the Ponzi debts of every other sucker? “Why is the federal government even in the pension program or the health care delivery program?” Perry asked. “Let the states do it.” Perry is currently on a national tour touting his book Fed Up! which is focused on the many ways the federal government should, in essence, get off the backs of the 50 states. The tools of federal tyranny Perry describes would be at home at any tea party rally: In a nutshell, taxes are too high, the EPA is too nosy and the health care reform law is an existential terror. It all goes back to the Founding Fathers, Perry says. “They did not believe that all of us would be alike, and they really didn’t like centralized government and mandating down to these states how to act, how to look,” he told NPR. Not surprisingly, some on the Democratic side of things are a bit skeptical of Perry’s new secession plan. On Parker-Spitzer last night, former New York Gov. Eliot Spitzer (D) took Perry on over his Social Security vision. Spitzer said Perry’s Social Security idea isn’t more widely discussed “because it doesn’t work.” Perry says seceding from Social Security is just one of many ways the system could get fixed — he said that raising the retirement age or privatizing parts of the system are changes he could support. He responded to comparing federal obligations to a perhaps unfortunately chosen article of clothing, considering he was debating the infamous Client 9. “I think all of those are legitimate options out there, but let the states decide,” Perry said. “Don’t force us from Washington, DC to say, ‘here is the size of tube socks that you’re gonna wear down in Texas. Rick Perry (R-TX) opposes a petition to allow Texas to secede from the United States following President Obama’s re-election, his press secretary Catherine Frazier said in a statement to the Dallas Morning News Monday afternoon. “Gov. Perry believes in the greatness of our Union and nothing should be done to change it. But he also shares the frustrations many Americans have with our federal government. Now more than ever our country needs strong leadership from states like Texas, that are making tough decisions to live within their means, keep taxes low and provide opportunities to job creators so their citizens can provide for their families and prosper. We cannot allow Washington’s tax and spend, one-size-fits-all mindset to jeopardize our children’s future, undermine our personal liberties and drive our nation down a dangerous path to greater dependence of government.” The petition is on the White House’s website under a section called “We the People: Your Voice in Our Government.” The White House promises to review and respond to petitions with over 25,000 signatures.
