The British government are so concerned that a panel of judges are able to overturn their decisions that they are contemplating leaving the European Court of Human Rights. Why then are they happy to sign up to a deal that gives corporations the right sue them if they take decisions that may be deemed to harm interests? The Transatlantic Trade and Investment Partnership (TTIP), now being negotiated between the USA and the EU, creates a special court for corporations that is not subject to any judicial review. The corporate lawyers who judge these cases are beholden only to the companies whose cases they adjudicate, who at other times are their employers. TTIP could be used to prevent UK governments from reversing the privatisation of the railways and the NHS, or from defending public health and the natural world against corporate greed. It must be opposed.
