The Federal Court has allowed the Negri Sembilan governments leave application to challenge the Court of Appeals ruling against a provision in the state religious enactment that criminalised cross-dressing by Muslims. A five man bench allowed one question to be argued during the appeal without hearing submission from opposing parties. The question is whether Section 66 of the Negri Sembilans Shariah Criminal enactment contravened Articles 5, 8, 9 and 10 of the Federal Constitution. Articles 5, 8, 9 and 10 guarantee protection of our fundamental liberties. Specifically, personal liberty (Article 5), right to equality (Article 8), freedom of movement (Article 9) and freedom of speech and expression (Article 10(1)), freedom of association (Article 10(3)). Will shariah law prevail over the Constitution, the supreme law of the land and see Malaysia race back to the dark ages? Or will we a see a brighter world? Only time will tell.
