The Honorable High court of Kerala Division Bench Justice Harilal and Justice Mohanan found Sunil Kumar Sahu SWA 3 was not suffering from any Psychiatric illness as per report submitted by NIMHANS. Therefore the court passed an Interim order to reinstate his leave which was granted to him prior to his admission in Hospital in the month of Oct 2014. He was granted 26 days casual leave (including 6 days TT) in Oct 2014 but was forcefully admitted in INS Sanjivani just 2 days prior to the commencement of leave. Navy now has decided not proceed the matter and left all the matter to court to decide to pass the order. Therefore the case is closed and Navy will not argue for any further hearing on 19th December. Sahu has been issued all the travel documents and will proceed on casual leave. He will board From Eranakulam Town in the Morning by 1000 and proceed to his home station Allahabad. The order passed by High Court on 11 Dec was only an interim order and the final judgment of this case will be announced on 19th December
