The Memorandum of Understanding re-typed for legibility: Agreement of the Saint Regis Mohawk Tribe and the State Of New York Where, as the Saint Regis Mohawk Tribe and the State of New York are committed to resolving longstanding disputes of mutual benefit of both their people and the continued prosperity of the entire Northern New York Region, Without the need for further costly litigation, the State and the Saint Regis Mohawk Tribe do hereby enter into this Memorandum of Understanding. 1. The Saint Regis Mohawk Tribe will immediately remit one half of the amount the State believes is outstanding from Exclusivity/Revenue Sharing obligations. 2. The remaining half being held by the tribe shall continue to be retained by the tribe, pursuant of our current financing agreement pending mutually agreeable resolution of the raised issues in the Chiefs correspondence and discussion with the Governor, including exclusivity status, land issues, and the New York Power Authority matters. 3. The State will exclude from pending gaming legislation, the citing of any commercial casino from the Tribal Exclusivity zone and receives Tribal support for the casino gaming referendum. 4. Tribe shall commence making timely payments at the next scheduled payment date pursuant to the Compact and the Tribe shall agree to forgo any arguments it may have to a breach of exclusivity based on the slot machine operations based at the Ganienkeh, except for the following. a. The State and Tribe shall agree to a reduction in payments based on the ‘Ganienkeh effect’----a mutually agreed upon amount equal to the estimated impact of the continued operation of Ganienkeh facility. Such amount to be subject reduction or increase, depending on the then current number of slot machines in operation in Ganienkeh. 5. The State and the Tribe shall commence discussions within 10 days to resolve outstanding issues.
