The U.S. Supreme Court let the public down when they decided Campbell v. State Farm and gave the green light to insurers to create salary incentives for adjusters to lowball claims. An Arkansas court recently allowed discovery of those incentives in an important order; saying: ...individual employee compensation is relevant to Sims’s bad-faith claim because it can show whether an employee was rewarded for achieving particular outcomes regarding claims. Similar documents are not needed, however, to show that an insurance company has a financial incentive to deny a claim: obviously, it does. Sims v. State Farm Mut. Auto. Ins. Co., No. 4:13CV00371 (E.D. Ark. Apr. 30, 2014).
